The new Advertising Law passed by the National Assembly supplements regulations related to the rights and obligations of advertisers.
The Law supplements provisions related to the rights and obligations of the person transmitting advertising products. Accordingly, the person transmitting advertising products has the right to be provided by the advertiser with truthful, complete and accurate information about the organization, individual, product, goods, service being advertised and documents related to advertising conditions. Has other rights as prescribed by law.
On the other hand, the person delivering the advertising product is obliged to comply with the provisions of the law on consumer rights protection and other regulations such as: providing information related to the features and quality of products, goods and services when advertising.
At the same time, this person must also fulfill tax obligations when generating revenue from advertising services according to the provisions of tax law.
The person who delivers the advertising product must provide documents related to the advertising content when requested by the competent State agency; Be responsible before the law in case the advertising content does not ensure the requirements according to regulations...
Previously, presenting a report on receiving, explaining and revising the draft law, Chairman of the Committee for Culture and Society Nguyen Dac Vinh said that there were opinions suggesting tightening regulations on people who transmit advertising products as influential people in the direction that only people with expertise related to the product can transmit advertising products.
Regarding this content, according to the current Standing Committee of the National Assembly, in the market mechanism, the participation of celebrities and influencers in advertising activities is a commercial activity with positive significance, contributing to promoting production, business, economic development, and encouraging innovation.
The bill stipulates additional obligations that advertising product carriers must fulfill to ensure stricter management. Therefore, the National Assembly Standing Committee requests to maintain the provision that does not restrict advertising for celebrities and influencers.
Along with that, there are opinions suggesting clarifying the feasibility of the regulation requiring influencers when transmitting advertising products to be obliged to verify the credibility of the advertiser.
The National Assembly Standing Committee believes that it is necessary to add specific and clear regulations on the rights and obligations of those who transport advertising products, in order to overcome the situation where some celebrities and influencers advertise falsely and advertise counterfeit and fake goods.
In particular, the obligation to "verify the credibility of advertisers" aims to enhance the responsibility of those who deliver advertising products to the community and society. Therefore, the National Assembly Standing Committee requests to keep the provisions as in the draft law.
In addition, there are suggestions to add regulations on the time and form of notification when influencers transmit advertising products. Regarding this content, the National Assembly Standing Committee would like to accept and revise it as in the draft law.
