New regulations on organization and operation of the Supreme People's Procuracy Inspectorate

(Chinhphu.vn) - The Chief Justice of the Supreme People's Procuracy has just issued the Regulations on the organization and operation of the Supreme People's Procuracy Inspectorate. Accordingly, the Supreme People's Procuracy Inspectorate is a department-level unit under the working apparatus of the Supreme People's Procuracy, and the Supreme People's Procuracy Inspectorate has its own seal.

Supreme People's Procuracy Inspectorate inspects the implementation of Inspection Conclusion at Provincial People's Procuracy

According to the Regulations, the Inspectorate of the Supreme People's Procuracy has the duties and powers to assist the Chief Prosecutor of the Supreme People's Procuracy in performing tasks, is the focal unit, and manages the state in the work of preventing and combating corruption, and performs the task of preventing and combating corruption in the People's Procuracy sector according to regulations.

Monitor and synthesize the results of handling denunciations of corruption related to civil servants, public employees and employees of the People's Procuracy.

Inspect professional activities in prosecution and supervision of judicial activities; public service and internal affairs activities; practice of thrift and combat of waste; and implementation of democracy at the grassroots level as assigned by the Chief Justice of the Supreme People's Procuracy.

Resolve complaints and denunciations about violations of law, professional discipline, and public ethics of civil servants, public employees, and workers in the Industry; matters within the scope of inspection concluded by lower-level People's Procuracies but discovered to have violations, and disciplinary decisions against civil servants, public employees, and workers of lower-level People's Procuracies that are subject to complaints.

Manage, monitor, guide and inspect the professional inspection work of lower-level People's Procuracies.

Receive, process and manage petitions according to the Regulations on receiving, processing and managing petitions outside the field of judicial activities under the jurisdiction of the Chief Justice of the Supreme People's Procuracy.

Monitor, urge, and inspect the implementation of inspection and examination conclusions, decisions on handling complaints, conclusions on denunciations, and recommendations issued by the Supreme People's Procuracy Inspectorate.

Inspect the compliance with internal discipline of agencies, units, civil servants, public employees, and workers of the Supreme People's Procuracy and lower-level People's Procuracies (when necessary).

At the same time, perform other tasks and powers assigned by the Chief Justice of the Supreme People's Procuracy.

Regarding working principles, the Regulations clearly state: The Supreme People's Procuracy Inspectorate operates according to the principle of collective leadership and individual responsibility. All activities of the Supreme People's Procuracy Inspectorate must comply with the provisions of law and regulations of the People's Procuracy sector. Civil servants of the Supreme People's Procuracy Inspectorate must perform within the scope of their duties and powers.

Ensure compliance with procedures, processes and deadlines for handling work in accordance with legal regulations, programs, plans and working regulations, except in urgent cases or when otherwise requested by the Supreme People's Procuracy leadership.

Ensure the promotion of civil servants' capacity and strengths, enhance coordination of work, and exchange of information in handling work according to functions, tasks, and powers prescribed by law.

Ensure democracy and transparency in all activities associated with implementing the Party and State's policies on administrative reform, public service reform, and civil servant reform.

Regarding the organizational structure, the Supreme People's Procuracy Inspectorate consists of the Chief Inspector, Deputy Chief Inspectors, Department Heads, Deputy Department Heads, Prosecutors, Inspectors of various ranks and other civil servants.

The Supreme People's Procuracy Inspectorate has 3 departments, including: Department of General Affairs and Post-Inspection Inspection (Department 1); Department of Professional Inspection and Complaints and Denunciations Settlement (Department 2); Department of Administrative Inspection (Department 3).

The staff of the Supreme People's Procuracy Inspectorate is part of the staff of the Supreme People's Procuracy.

In addition, the Regulation also clearly states the relationship between the Supreme People's Procuracy Inspectorate and the lower-level People's Procuracy. Accordingly, the Supreme People's Procuracy Inspectorate provides professional guidance on inspection work for the lower-level People's Procuracy; notifies the lower-level People's Procuracy of the Supreme People's Procuracy's leadership of the direction (when authorized by the Supreme People's Procuracy's leadership).

The lower-level People's Procuracy is responsible for studying the instructions of the Supreme People's Procuracy Inspectorate to apply the law correctly and in accordance with the reality at its level.

In case of disagreement with the Inspector's instructions, discuss with the Inspector of the Supreme People's Procuracy. If the Inspector of the Supreme People's Procuracy disagrees, it can report to the leader of the Supreme People's Procuracy for decision.

This Decision takes effect from the date of signing, replacing Decision No. 185/QD-VKSTC dated June 10, 2024 on promulgating the Regulation on organization and operation of the Supreme People's Procuracy Inspectorate and Decision No. 339/QD-VKSTC dated September 30, 2024 on amending Regulation 185/QD-VKSTC of the Chief Prosecutor of the Supreme People's Procuracy.
