Continuing the working program of the 7th Session, on the morning of June 3, the National Assembly discussed in the hall the draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended).
It is necessary to supplement the high-damage knife as a primitive weapon.
Clause b, Article 3 of the draft Law on Management and Use of Weapons, Explosives and Supporting Tools stipulates: A highly lethal knife is a sharp knife, a pointed knife and a sharp knife with a blade length of 20cm or more or a blade length of less than 20cm but converted or assembled to have the same function and effect as a highly lethal knife in the list of primitive weapons issued by the Minister of Public Security. The use of highly lethal knives for labor, production and daily life purposes is not within the scope of this Law.
This content received the attention of many National Assembly delegates during the discussion session in the hall at the 7th Session on the morning of June 3. The majority of delegates agreed to add "highly lethal knives" to the group of primitive weapons. Presenting his views, delegate Nguyen Viet Ha ( Tuyen Quang delegation) and many delegates suggested that it is necessary to add highly lethal knives as primitive weapons. Out of a total of 28,715 cases of illegal use of weapons, explosives, and supporting tools to commit murder, robbery, intentional injury, resisting law enforcement officers, disturbing public order, etc., there were up to 25,378 cases (accounting for 88.4%) in which the subjects used primitive weapons, knives, and knife-like means to commit crimes.

In particular, the subjects used knives to commit crimes in 16,841/25,378 cases (accounting for 66.4%), many cases involved subjects using sharp, highly lethal knives (cleavers, machetes, machetes...) to kill people with very violent details, causing outrage and confusion in public opinion.
Agreeing with the above viewpoint, delegate Nguyen Van Canh (Binh Dinh delegation) said that the regulation of highly lethal knives is a sharp knife, a pointed knife and a sharp knife with a blade length of 20cm or more or a blade length of less than 20cm but converted or assembled to have the same function and effect as a highly lethal knife... (Point b, Clause 4, Article 3 of the draft Law) will increase deterrence for those with criminal records who frequently disturb public order and assault others. These subjects will no longer take advantage of using knives to commit illegal acts or threaten to harm others.

Commenting on the draft regulation on highly lethal knives to help prevent crime, delegate Nguyen Dai Thang ( Hung Yen delegation) added: "In fact, recently many gangs have used homemade weapons and gathered. There was a case reported by the press late at night when people brought pig-stabbing knives attached to iron pipes and dragged them on the road, revved their motorbikes and were ready to commit crimes, causing public panic."
Need to continue to clarify concepts and get in-depth opinions
Regarding the regulation that using a knife with high lethality for work, production, or daily life purposes is not considered a weapon, delegate Thang commented: It is very difficult to determine when a knife is a weapon and when it is used for production or daily life purposes. There are types of knives that are used every day, but when used to commit crimes, they are highly lethal.
Therefore, the delegate suggested that the drafting committee continue to evaluate more carefully and comprehensively, and have stricter regulations to ensure legal and practical basis, avoiding disruption to people's lives and production.

Delegate Thach Phuoc Binh (Tra Vinh delegation) also said: Knives are easy-to-see tools that appear frequently in daily life and this item can easily be turned into a weapon to commit crimes. However, if knives are defined as a type of weapon and knife owners are treated as illegal possession and use of weapons, many problems may arise and conflicts between social life and the law. If knives are listed as primitive weapons, people's daily activities will be more or less affected.
Therefore, to ensure social stability, delegates suggested that it is necessary to conduct surveys and collect more in-depth opinions from people who are affected by law violations to assess the seriousness of dangerous items, thereby issuing specific regulations that are suitable for real life.

Regarding the regulation on declaration when buying and selling knives or weapons and tools, delegate Dong Ngoc Ba (Binh Dinh delegation) emphasized: "Declaration before production or after production is not clearly stated in the law. If buying and selling, do all cases have to be declared? How to declare when only buying and selling? How to declare when selling knives, right when making the transaction or declaring periodically? Although we have assigned the Government to specify in detail, it is necessary to clarify to avoid infringing on the rights of organizations and individuals."
Also concerned about the risk of wrongful convictions, delegate Tran Khanh Thu (Thai Binh Delegation) said that it is necessary to clearly define cases involving knives to avoid affecting people using knives in their daily lives. Ms. Thu also suggested that surgical knives in the medical sector are not subject to this law.
At the discussion session, the majority of National Assembly deputies agreed with the necessity of promulgating the Law on Management and Use of Weapons, Explosives and Supporting Tools (amended) to fully and promptly institutionalize the Party's guidelines and policies, the State's policies and laws on strengthening the management and use of weapons, explosives and supporting tools. At the same time, reform administrative procedures, reduce unnecessary paperwork to ensure compliance with reality, create favorable conditions for agencies, organizations and people; create a solid legal corridor in state management and prevent and combat crimes and violations of the law in this field. In addition, overcome shortcomings, limitations and obstacles in the implementation and application of the law in the past.
Delegates said that the draft law has mentioned relatively fully issues related to the responsibilities of agencies, organizations and individuals when assigned to manage, preserve, transport and use weapons, explosives and supporting tools to protect national security, ensure social order and safety, protect human rights, civil rights and serve socio-economic development.
