How to stop and park properly?

According to Article 18 of the 2008 Road Traffic Law, stopping and parking are two completely different states.

Specifically, stopping a vehicle is a temporary stationary state of a vehicle for a period of time necessary for people to get on or off the vehicle, load or unload goods or perform other work.

Parking is a stationary state of a vehicle without time limit.

Accordingly, when stopping or parking a vehicle, the following regulations must be followed to avoid being fined:

First, stop and park on the road.

Article 18 of the 2008 Road Traffic Law stipulates that when stopping or parking a vehicle, it is necessary to: Give a signal to notify other vehicle drivers; Stop or park the vehicle at a place with a wide sidewalk or a land area outside the roadway; in case the sidewalk is narrow or there is no sidewalk, the vehicle must stop or park close to the edge of the road on the right side in the direction of travel; In case the road has built a place to stop or park the vehicle or has specified stopping or parking spots, the vehicle must stop or park at those locations; After parking, the vehicle may only leave the vehicle after taking safety measures; if the vehicle is parked and occupies part of the roadway, a danger sign must be placed immediately in front and behind the vehicle to inform other vehicle drivers; Do not open the vehicle door, leave the door open or get out of the vehicle without ensuring safety conditions; When stopping the vehicle, the engine must not be turned off and the driver's seat must not be left; Vehicles parked on a slope must have their wheels chocked.

Do not stop or park your vehicle in the following locations: On the left side of a one-way street; On curves and near the top of a slope with obstructed visibility; On bridges, under overpasses; Parallel to another vehicle that is stopping or parking; On the roadway for pedestrians to cross the road; At intersections and within 5 meters from the edge of the intersection; At bus stops; In front of and within 5 meters on both sides of the gate of an agency or organization's headquarters; At a roadway with a width only wide enough for one lane; Within the safety zone of a railway; Obscuring road signs.

Second, stop and park on the street

Article 19 of the 2008 Road Traffic Law stipulates that when parking on the street, you must: Comply with the regulations as when stopping or parking on the road; You must stop or park the vehicle close to the curb or sidewalk on the right side of the road in the direction of travel; the nearest wheel must not be more than 0.25 meters from the curb or sidewalk and must not obstruct or endanger traffic. In case of narrow streets, you must stop or park the vehicle at least 20 meters away from the car parked on the other side of the road.

Do not stop or park on tram tracks, on drainage manholes, telephone or high voltage lines, or in areas reserved for fire trucks to get water. Do not leave vehicles on the roadway or sidewalk in violation of regulations.

Third, stop and park on highways and road tunnels

According to Article 26 of the 2008 Road Traffic Law, when participating in traffic on the highway, vehicles may only stop or park in designated areas; in case of being forced to stop or park in an incorrect location, the driver must move the vehicle off the roadway; if this is not possible, the driver must signal to other drivers.

According to Article 27 of the 2008 Road Traffic Law, when participating in traffic in road tunnels, vehicles may only be stopped or parked in designated areas.

Thus, when stopping or parking a car, you must comply with the above regulations to avoid being fined directly or indirectly without knowing.

Penalties for stopping and parking cars in violation of regulations

According to Article 5 of Decree 100/2019/ND-CP, amended and supplemented by Decree 123/2021/ND-CP, the penalties for cars that stop or park in violation of regulations are as follows:

Fine from 300,000 VND to 400,000 VND: When stopping or parking a vehicle without signaling to let other drivers know;

Fine from 400,000 VND to 600,000 VND:

+ Stopping or parking on the roadway in a section of road outside urban areas where the sidewalk is wide; stopping or parking not close to the right edge of the road in the direction of travel in a road with a narrow sidewalk or no sidewalk; stopping or parking against the direction of traffic of the lane; stopping or parking on a fixed median strip between two sections of the roadway; parking on a slope without chocking the wheels; opening the car door or leaving the car door open unsafely;

+ Stopping the vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25 m from the curb or sidewalk; stopping the vehicle on a tramway or bus lane; stopping the vehicle on a drainage manhole, the opening of a telephone or high-voltage power line, or a place reserved for fire trucks to get water; leaving the driving position or turning off the engine when stopping the vehicle; stopping or parking the vehicle in an incorrect location in sections with designated parking areas; stopping or parking on the road section reserved for pedestrians; stopping where there is a "No stopping or parking" sign, except for violations specified in Point i, Clause 4, Point d, Clause 7, Article 5 of Decree 100/2019/ND-CP;

Fine from 800,000 VND to 1,000,000 VND:

+ Failure to comply with regulations on stopping and parking at road intersections at the same level as railways; stopping and parking within the safety zone of railways, except for violations specified in Point b, Clause 2, Point b, Clause 3, Article 49 of Decree 100/2019/ND-CP;

+ Stopping or parking at locations: at road intersections or within 05 m from the edge of the intersection; bus stops; in front of or within 05 m on both sides of the gate of the headquarters of an agency or organization with a road for cars to enter and exit; where the road section is only wide enough for one lane; obscuring road signs; where the median strip is open;

+ Parking a vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25 m from the curb or sidewalk; parking on a tramway or bus lane; parking on a drainage manhole, a telephone or high-voltage power line, or a space reserved for fire trucks to get water; parking or leaving a vehicle on the sidewalk in violation of the law; parking where there is a "No Parking" sign or a "No Stopping and Parking" sign, except for violations specified in Point i, Clause 4, Point d, Clause 7, Article 5 of Decree 100/2019/ND-CP;

Fine from 2,000,000 VND to 3,000,000 VND:

+ Stopping or parking a vehicle at the following locations: On the left side of a one-way road or on the left side (in the direction of traffic) of a dual carriageway; on a curved road or near the top of a slope where visibility is obstructed; on a bridge, under an overpass, parallel to another vehicle that is stopping or parking, except for violations specified in Point d, Clause 7, Article 5, Decree 100/2019/ND-CP;

+ Stopping, parking, or turning the vehicle in violation of regulations causing traffic congestion;

Fine from 10,000,000 VND to 12,000,000 VND:

+ Stopping, parking, turning, reversing, avoiding, overtaking, changing direction, or changing lanes in violation of regulations causes traffic accidents;

+ Stopping or parking on the highway in an incorrect place; not signaling to let other drivers know when forced to stop or park on the highway in an incorrect place; making a U-turn on the highway;

Thus, the act of stopping or parking a car in violation of regulations will be fined from 300,000 to 12 million VND.
