(MPI) - Decree No. 113/2024/ND-CP dated September 12, 2024 of the Government stipulates the general support process for all policies, in the direction of facilitating cooperatives, cooperatives, and cooperative unions to access the State's support policies, in accordance with the existing procedures of the law on the State budget and public investment, while supplementing specific regulations on the active and proactive participation and supervision of cooperatives, cooperatives, and cooperative unions themselves right from the stage of proposing support needs, implementing and supervising policy implementation to ensure that support projects are targeted to the right subjects and needs and improve investment efficiency.

Accordingly, the Decree stipulates that cooperative groups, cooperatives, and cooperative unions shall submit 01 set of documents registering support needs to the People's Committee of the commune where the cooperative group has its transaction address, where the cooperative or cooperative union has its head office.
The application for support needs includes: First, the application for support needs, which includes a commitment not to violate prohibited acts as prescribed in Clause 2, Article 7 of the Law on Cooperatives, and not to be serving a criminal sentence of the Court that has come into legal effect according to Form No. 01 in the Appendix issued with this Decree.
Second, relevant documents and records showing compliance with the beneficiary criteria as prescribed in Points b and c, Clause 1; Points a and c, Clause 2; Clause 3, Article 6 of this Decree. These relevant documents and records are copies.
Third, for support in infrastructure investment, equipment, transfer of infrastructure works, public works and other infrastructure of the State to cooperatives, cooperatives and cooperative unions, there must be a meeting minutes with the signatures and agreement of 100% of the cooperative group members, a Resolution of the Board of Directors in case of cooperatives and cooperative unions organized under a full management organization or a Resolution of the General Meeting of Members in case of cooperatives and cooperative unions organized under a shortened management organization.
Regarding submission of documents, the Decree clearly stipulates: Cooperative groups, cooperatives, and cooperative unions submit directly or send via postal service or electronically.
In case cooperatives, cooperative unions, and cooperative groups submit documents via the electronic environment, the reception and settlement of administrative procedures shall comply with the provisions of law on performing administrative procedures in the electronic environment.
Commune-level People's Committee: No later than 10 days from the date of receiving the dossier, the Commune-level People's Committee shall notify the cooperative group, cooperative, or cooperative union of the receipt of the dossier according to Form No. 02 in the Appendix issued with this Decree.
Before May 31 every year (or at the request of competent state agencies), synthesize the needs of cooperative groups, cooperatives, and cooperative unions in the area, send them to the District People's Committee for general synthesis, as a basis for competent agencies to consider and support.
In cases where the commune level has the capacity and resources to provide support, the People's Committee at the commune level shall consider and directly provide support to cooperative groups, cooperatives, and cooperative unions according to its authority.
District People's Committee: Synthesize support needs for cooperative groups, cooperatives, and cooperative unions from commune People's Committees; Provide to agencies and units with the capacity and authority to support upon request or before June 30 every year to report to the provincial People's Committee for consideration of support.
In case of capacity and resources, the People's Committee at district level shall consider and directly provide support to cooperative groups, cooperatives, and cooperative unions according to its authority.
The preparation, appraisal, approval of investment policies, approval of investment decisions, and handover of projects to support cooperative groups, cooperatives, and cooperative unions shall comply with the provisions of the law on public investment, state budget, relevant legal provisions, and the following provisions:
The dossier submitted to the competent authority for approval of investment policy and investment approval must include the document of the cooperative group, cooperative, or cooperative union agreeing on the support content related to that cooperative group, cooperative, or cooperative union;
Members of the Community Investment Supervision Board: in addition to the composition prescribed in Clause 1, Article 17 of Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on Democracy Implementation at the Grassroots Level, at least 02 members representing supported cooperative groups, cooperatives, and cooperative unions must be added;
The dossier for handing over infrastructure and equipment after investment must include the acceptance document of the cooperative group, cooperative, or cooperative union; For the overall project to support the provincial collective economy using central budget capital: implement according to the provisions of Article 13 of this Decree.
The preparation of budget estimates and implementation of support contents for cooperative groups, cooperatives, and cooperative unions using regular expenditure funds shall comply with the provisions of the law on the state budget.
For subjects being state agencies, organizations, associations, and unions assigned tasks; cadres, civil servants, public employees, and workers working in these agencies, organizations, associations, and unions according to the support policies in Articles 7, 9, and 15 of this Decree: the support process is implemented according to the provisions of the law on cadres, civil servants, and public employees and relevant legal provisions.
Payment and settlement records of state budget funds to support cooperative groups, cooperatives, and cooperative unions according to the provisions of the law on state budget.
Cooperative groups, cooperatives and cooperative unions are responsible before the law for the accuracy and honesty of the information provided in the registration dossier for support needs specified in Clause 2 of this Article.
When the competent authority carrying out support activities discovers that the information provided by the cooperative group, cooperative, or cooperative union is dishonest or violates the commitments in the Application for support needs, the cooperative group, cooperative, or cooperative union that has been selected to benefit from the policy will have its policy implementation stopped and will be handled according to the provisions of law./.
