The Department of E-commerce and Digital Economy ( Ministry of Industry and Trade ) informed as above, in response to reports that the Temu e-commerce platform is currently inactive.
Information with Electronic Newspaper VTC News , the media representative of the Department of E-commerce and Digital Economy , said that Elementary Innovation Pte. Ltd - the owner of the Temu e-commerce platform - has submitted an application to register to provide e-commerce services through the e-commerce management portal (online.gov.vn).
The Department of E-commerce and Digital Economy has reviewed and requested Temu to supplement the dossier. To date, Temu has submitted the second amendment and supplement dossier. The Department of E-commerce and Digital Economy is in the process of reviewing the dossier content according to the provisions of Decree No. 52/2013/ND-CP (amended and supplemented by Decree No. 85/2021/ND-CP) on e-commerce.
During the time of completing the dossier, Temu has implemented a number of requests of the Department of E-commerce and Digital Economy - Ministry of Industry and Trade. Specifically:
Temporarily stop providing e-commerce services in Vietnam (do not use Vietnamese language when providing services on website Temu.com and Temu mobile application).
There is a warning to consumers that the website is in the process of registering to provide e-commerce services with the Ministry of Industry and Trade. This warning is to let consumers know that this is a website or application that has not been licensed by the Ministry of Industry and Trade and that they should be cautious when making transactions.
Remove promotional programs that do not comply with the provisions of the law on trade promotion according to Vietnamese law. All products and goods with promotions of over 50% will be removed according to the provisions of Decree No. 81/2018/ND-CP dated May 22, 2018 of the Government detailing the Commercial Law on trade promotion activities and other relevant laws.
Eliminate programs and models that call on users to participate in business to enjoy various bonuses and commissions in the Vietnamese market.
Also replied VTC News , Mr. Hoang Ninh - Deputy Director of the Department of E-commerce and Digital Economy - also confirmed this information. According to Mr. Ninh, the Department has requested Temu to comply with the regulations of Vietnamese law on e-commerce. Accordingly, Temu has submitted its registration documents but is still in the process of completion. Only when the documents are complete will the Ministry of Industry and Trade approve.
The Ministry has announced that if the registration procedure in Vietnam is not completed by November 30, the Temu exchange must stop operating. Therefore, the Ministry of Industry and Trade has recently requested Temu to temporarily stop operating until the registration procedure is completed.
“ Up to this point, they have complied with the regulations, are continuing to complete the documents and the Department is reviewing the documents. Temu's suspension of operations in Vietnam is also due to the request of the Department of E-commerce and Digital Economy. When they complete and have all the documents, they will continue to operate, ” Mr. Ninh informed.
In addition, talking about the recent issue of consumers shopping on Temu but not receiving their goods, Mr. Ninh said that it could be due to customs regulations not clearing goods for e-commerce platforms that are not registered with the Ministry of Industry and Trade, causing Temu's goods to not be allowed to enter Vietnam.
“In case consumers cannot wait for Temu to complete the documents to continue doing business in Vietnam, they can request a refund. In case Temu does not return the goods or refund, when receiving feedback from consumers, the Department will intervene to ensure the rights of shoppers,” Mr. Ninh said.
Previously, the Ministry of Industry and Trade warned consumers about the risks of shopping on unregistered cross-border e-commerce platforms. These platforms are not subject to supervision by authorities regarding product quality or after-sales service commitments. When consumers discover that the product they receive is not as described, has errors, is damaged, or poses a risk to safety or health, it is difficult for them to request a refund or warranty. When disputes arise, the complaint resolution process will be lengthy and very complicated.
On the other hand, when making purchases, consumers often have to provide international payment information such as credit cards or e-wallet information. If this data is not managed and protected according to Vietnamese law, it is at risk of being stolen or illegally exploited, leading to major risks in personal information security.
In addition, consumers may incur additional costs due to taxes that were not anticipated or not as initially announced.
As Electronic Newspaper VTC News reported that, according to many customers' feedback, recently, when accessing this e-commerce site, Vietnamese is no longer supported, accompanied by a message (in English): " Temu is working with the Vietnam E-commerce and Digital Economy Agency and the Ministry of Industry and Trade to register to provide e-commerce services in Vietnam ". The entire Temu platform, from the website to the mobile application, no longer displays Vietnamese but only supports 3 languages: Chinese, English and French.
Many people said they have ordered for a month now but have not received their goods and have not received a refund. Some people said they had purchased a defective product and were told by Temu that they would be refunded. However, customers chose to have their money refunded to their Temu account because they thought they would buy more products and now they cannot withdraw it.
Most of Temu's transactions as well as programs and commission policies for Affiliate Marketing are no longer available. Temu announced to cut this entire program.
