On the morning of March 20, the National Assembly Standing Committee questioned Chief Justice of the Supreme People's Court Nguyen Hoa Binh . Responding to delegate Nguyen Huu Thong ( Binh Thuan delegation) asking about solutions to improve the quality of trials with the current number of staff and the reality that many judges are under pressure during trials because of inadequate treatment and protection, Chief Justice Nguyen Hoa Binh reported that in reality, the court system has only 15,300 people but the number of cases in a year is up to hundreds of thousands.
By the end of 2022, the court system will have to handle 570,000 cases, double the number, but the staff must be reduced by 10% in accordance with the general spirit. This creates pressure on the court, and the quality of the trial is also affected.
“On average, each judge has to handle 5-6 cases per month, and in some localities, more than 10 cases. Handling so many cases in one month will somehow affect the quality,” said Chief Justice Nguyen Hoa Binh.

Mr. Binh said that the Supreme People's Court has submitted a request to the National Assembly Standing Committee to maintain the court's payroll without reducing it by 10% according to general regulations.
“We refer to the experience of many countries to see if 600,000 cases/year is the stopping point? For a country of 100 million people like Vietnam, the number of trials is 1.5-2 million cases, so the number of cases can increase and not stop at 600,000 cases/year. In the context of a shortage of staff, the quality of trials must still be improved,” Mr. Binh affirmed.
Regarding the mechanism to protect judges, the Chief Justice of the Supreme People's Court confirmed that Vietnam's regime and policies are worse than those of many countries, while many countries have clear protection mechanisms.
Delegate Nguyen Hoang Bao Tran (Binh Duong delegation) mentioned the information that the mediation center was established but its performance was low. Could the Chief Justice please tell us about the actual effectiveness of implementing dialogue mediation outside of court?

In response, Chief Justice of the Supreme People's Court Nguyen Hoa Binh said that many countries consider the law on mediation as a breakthrough to replace adjudication. According to him, all disputes in society, if mediated, will have many effects.
“All conflicts that are agreed upon and resolved amicably will help reduce the cost of opening a trial or the cost of executing a judgment, because after the court's verdict is announced, there are still costs of executing the judgment and sometimes conflicts continue to arise,” said Mr. Binh.
From there, he affirmed that mediation is an institution to resolve social conflicts in a peaceful and healing way. In fact, in recent years, the mediation rate has been about 72,000 cases out of a total of 600,000 cases to be resolved. This number is not high, but according to Mr. Binh, it helps to significantly reduce the number of cases that the court has to handle, helping to resolve the pressure when "there are too many cases and too few judges". Most importantly, according to Mr. Binh, mediation resolves conflicts in a friendly way, so it is very effective.
At the questioning session this morning, Chief Justice of the Supreme People's Court Nguyen Hoa Binh will answer questions on the following groups of issues:
- Solutions to continue improving the quality of trials and resolution of all types of cases, especially administrative cases, criminal cases on economics and corruption; and the resolution of requests for review and retrial.
- Personnel work of the Court sector; solutions to improve the capacity, qualifications, courage and responsibility of judges and civil servants; prevention and handling of corruption and negativity within the Court sector.
- Summarizing trial practices, guiding the unified application of law, and developing case law.
- Implementation of Resolution No. 33/2021 of the National Assembly on organizing online trials, especially preparing conditions to ensure online trials.
