The Hanoi People's Committee has issued Decision 20/2023/QD-UBND on amending, supplementing, and adjusting regulations and price lists of land types in Hanoi, applicable from January 1, 2020 to December 31, 2024.
Specifically, the new decision has amended Clause 1, Article 1, Decision No. 30/2019/QD-UBND on the land price list used as a basis in the following cases: Calculating land use fees when the State recognizes the right to use residential land of households and individuals for the area within the limit; allowing the change of land use purpose from agricultural land, non-agricultural land that is not residential land to residential land for the area within the limit of land allocation for households and individuals; calculating land use tax; calculating fees and charges in land management and use; calculating fines for administrative violations in the land sector; calculating compensation to the State for causing damage in land management and use; Calculate the value of land use rights to pay for people who voluntarily return land to the State in cases where the returned land is land allocated by the State with land use fees collected, recognized land use rights with land use fees collected, or leased land with one-time land rent payment for the entire lease term.
Amending Point b, Clause 2, Article 3 of Decision No. 30/2019/QD-UBND, for a land plot of a land user at location 2, location 3 and location 4 of tables 5, 6 (except Tay Dang town, Ba Vi district) and table 7 in old residential areas (not located in new urban areas, auction areas, industrial clusters or industrial parks) if the distance along the current line from the first boundary of the land plot to the road (street) named in the price list is equal to or more than 200 m, the land price is reduced as follows: Distance 200 - 300 m, reduced by 5% compared to the prescribed land price; distance 300 - 400 m, reduced by 10% compared to the prescribed land price; distance 400 - 500 m, reduced by 15% compared to the prescribed land price; distance from 500 m or more, 20% discount compared to the regulated land price.
Point c, Clause 2, Article 3 of Decision No. 30/2019/QD-UBND is also amended, for land plots of a user at locations 2, 3, 4 with alleys directly connecting to many roads (streets) specified in the land price list, the land price is determined according to the location of the road (street) with the highest price (taking into account the deduction factor at Point b, if any).
Points a and b, Clause 3, Article 3 of Decision No. 30/2019/QD-UBND on sidewalk and street boundaries stated in Clauses 1 and 2, Article 3 shall apply: In the case of land plots allocated or leased by the State, sidewalk (street) boundaries shall be calculated according to the current road boundaries. In the case of land plots allocated or leased by the State in different phases, sidewalk (street) boundaries shall be calculated according to the current road boundaries of the entire project.
Amending the provisions in Clause 5, Article 6 of Decision No. 30/2019/QD-UBND, the land plot of the user at location 4 of wards in Son Tay town (Vien Son, Trung Hung, Trung Son Tram) specified in Table 5 is determined: Within the range from the sidewalk (street) boundary named in the price list to 200 m is determined according to location 4; beyond 200 m from the sidewalk (street) boundary named in the price list, the price is determined according to specific regulations in Table 9.
Also according to Decision No. 20/2023/QD-UBND, Clause 4, Article 6 of the Regulation is abolished; the land price column "Outside the 200 m range" in tables No. 7 is abolished; land prices of some roads and streets in the land price table are adjusted, supplemented, and removed. Other contents of Decision No. 30/2019/QD-UBND remain legally valid.
