Clearly define the authority of the National Assembly and the Government
Giving opinions on the Draft Report on the work of the 15th National Assembly , delegates of Group 4 (including the National Assembly delegations of Khanh Hoa , Lai Chau and Lao Cai provinces) agreed that the content of the draft report is complete, clarifying the results achieved, thereby demonstrating the outstanding performance of the National Assembly throughout the term.
National Assembly Deputy Le Xuan Than (Khanh Hoa) acknowledged that in legislative work, we are implementing the spirit of Resolution No. 66-NQ/TW on innovation in law-making and enforcement to meet the requirements of national development in the new era.
Since the Ninth Session, the huge amount of legislative work has required great determination from the entire system. The spirit of innovation in legislative work has also been implemented.
“There are draft laws and draft resolutions that were developed and promulgated in an extremely short time - something that had not been done before, demonstrating the correctness of the law-making work, promptly meeting the country's development requirements,” said delegate Le Xuan Than.
The Draft Report on the work of the 15th National Assembly clearly states: " Innovate legislative activities in the direction that the law only regulates issues under the authority of the National Assembly, and the contents that change frequently and are not stable are only regulated in principle and assigned to the Government , ministries, branches, and local authorities to regulate to ensure flexibility in management and operation, in accordance with reality".
Delegate Le Xuan Than said that this is a principle that has been affirmed in the law and is consistent with the Party's guidelines.
However, at the Ninth Session, the drafts submitted to the National Assembly still did not meet this requirement, meaning that the boundary to distinguish the authority of the National Assembly from the Government is still unclear.

According to the delegate, the 2013 Constitution has stipulated the duties and powers of the National Assembly (Article 70), the duties and powers of the Government (Article 96). Therefore, it is necessary to continue to research and clearly define the issues under the jurisdiction of the two parties. From there, according to the innovation perspective in law-making, the laws will not be as long as before.
“The National Assembly’s task is to raise issues of a stable, long-term, principled, policy-making nature, and the Government must comply and implement them. Only then will there be no duplication and no need to amend the law too much.” Delegate Le Xuan Than said that during the 16th National Assembly term and subsequent terms, this content should continue to be emphasized.
The above opinion also received the approval of many delegates. The delegates said that clearly defining the authority of the National Assembly and the Government will avoid duplication and overlap.
Clarify the position of the National Assembly Delegation and the Deputy Head of the Delegation
Delegate Le Xuan Than also suggested that a legislative technical editorial team should be established by the National Assembly Standing Committee to act as a filter for draft laws submitted to the National Assembly, helping to present the drafts in a unified manner. At that time, National Assembly delegates would only need to focus on researching and giving opinions on the content of the regulations, instead of giving opinions on legislative techniques as is currently the case.

Sharing the above opinion, National Assembly Deputy Hoang Quoc Khanh (Lai Chau) added that to improve the quality of the National Assembly's activities, first of all, it is necessary to improve the quality of National Assembly deputies by increasing the number of full-time deputies.
Currently, the average number of full-time representatives in localities is 1-2 people. In the next term, it is necessary to calculate to increase this number, thereby also contributing to improving the quality of representatives - a factor that plays a very important role in the quality of the National Assembly's activities. Along with that, it is necessary to consider and arrange for re-election of representatives who have working experience.
Regarding supervision work, delegate Hoang Quoc Khanh said that in this term, the National Assembly and the National Assembly Standing Committee have regularly organized thematic supervisions. However, the actual working time at the grassroots level of some supervisions is still not satisfactory, more time should be spent listening to the reality, thereby the assessment report will be more complete, objective and accurate.
In addition, according to the delegate, it is necessary to build a better coordination mechanism between the National Assembly agencies and the agencies drafting laws and resolutions, which will ensure better quality of the drafts.
Affirming the need to clearly define the authority of the National Assembly and the Government as well as increase the number of full-time deputies to ensure more professionalism and efficiency in legislative activities, supervision, and decision-making on important issues of the country, National Assembly Deputy Le Huu Tri (Khanh Hoa) suggested that the position and status of the National Assembly Delegation and the Deputy Head of the full-time Delegation in the local political system should be more clearly considered.

At the local level, the National Assembly delegations and specialized deputy heads of delegations still face difficulties in their operations. Sometimes they are placed under the Fatherland Front, sometimes under the People's Council, and it is unclear which order they belong to in the local political system. Therefore, the 16th National Assembly needs to make adjustments and clearly establish the legal status of the National Assembly delegations and specialized deputy heads of delegations, in order to promote their role in supervision and implementation of other issues.
Consider amending the Law on Commercial Arbitration
Also related to legislative work, delegate Le Xuan Than stated that in recent times, the Party and the National Assembly have paid great attention to the development of the private economy, as shown in Resolution No. 68-NQ/TW and at the Ninth Session, the National Assembly issued many relevant regulations and policies. At the Tenth Session, laws related to the economy will also be amended.
Emphasizing that this is a very positive thing for the country's development, delegate Le Xuan Than noted that when the economy develops, disputes are inevitable. This requires a dispute resolution mechanism, including courts and commercial arbitration.
Currently, the Law on Organization of People's Courts has been amended, along with the Civil Procedure Code, but the Law on Commercial Arbitration 2010 has not yet been included in the law and ordinance-making program. Meanwhile, in recent years, commercial arbitration has been chosen by businesses to resolve disputes; this is also a common trend in other countries.
From this reality, delegates proposed that it is necessary to include the amendment of the Law on Commercial Arbitration in the law and ordinance building program to serve the country's development.
