On November 15, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law amending and supplementing a number of articles of the Law on Health Insurance (HI).

Remote medical examination and treatment at home is covered by health insurance

Reporting at the meeting, Chairwoman of the National Assembly 's Social Committee Nguyen Thuy Anh said that the agencies have made efforts to rationalize the draft Law in the direction of ensuring clear, substantive, concise, easy-to-understand, easy-to-implement provisions, closely following reality, ensuring feasibility. In addition, the subjects of village health workers and village midwives were added to encourage, motivate and have appropriate policies for the subjects of health care for people in remote and isolated areas and fairness with other subjects in residential groups.

At the same time, Article 13 of the draft Law has adjusted the regulations on the contribution level and responsibility for health insurance contribution to synchronize with the amendment of health insurance participants. In particular, it stipulates that students continue to participate in the group of subjects supported by the state budget to ensure stability when participating in health insurance of this group of subjects.

Ms. Thuy Anh also said that, absorbing the opinions of National Assembly deputies and to be consistent with the Law on Medical Examination and Treatment 2023, the draft Law has supplemented and clarified new forms of medical examination and treatment that are covered by health insurance such as: Remote medical examination and treatment; family medical examination and treatment; medical examination and treatment at home.

Also according to Ms. Nguyen Thuy Anh, the regulation on health insurance benefits is designed on the basis of eliminating "administrative boundaries" in medical examination and treatment according to the direction of the National Assembly Standing Committee, maintaining the stability of health insurance benefits according to the provisions of the current Law and expanding to some cases, such as rare diseases, serious diseases that are sent directly to specialized medical examination and treatment facilities.

“Regarding the management and use of the health insurance fund, taking into account the opinions of National Assembly deputies, the draft Law stipulates increasing the allocation from health insurance revenue to spend on medical examination and treatment activities to 92%, reducing the amount of money for the reserve fund and organizing the activities of the health insurance fund to 8%” - Ms. Thuy Anh informed.

Anticipate problems

Mr. Le Tan Toi, Chairman of the National Assembly's Committee on National Defense and Security, said that the current regulations on health insurance participants include people with revolutionary contributions and veterans who are covered by the state budget. Therefore, Mr. Toi proposed adding former police officers to the group covered by the state budget.

According to Mr. Hoang Thanh Tung - Chairman of the National Assembly's Law Committee, Article 151 of the Law on Promulgation of Legal Documents stipulates the effective date of all or part of a legal document as prescribed in that document, but not earlier than 45 days from the date of approval or signing for promulgation of legal documents of central state agencies.

However, Mr. Tung pointed out that for this Law project with some contents taking effect from January 1, 2025, it will not ensure compliance with the Law on Promulgation of Legal Documents. On that basis, Mr. Tung said that it is necessary to study the handling plan and fully explain.

Concluding the session, Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that the amendments and supplements to a number of articles of the Law on Health Insurance have basically met the set goals and viewpoints, gradually institutionalizing the Party's guidelines and policies on health insurance, in sync with the provisions of the Law on Medical Examination and Treatment and the Law on Social Insurance.

However, to ensure feasibility, especially the new contents of the Law, the National Assembly Standing Committee requested the Government to direct competent authorities to do a good job of information and propaganda so that all people, medical examination and treatment facilities, medical staff and relevant agencies and organizations clearly understand and fully and accurately implement the provisions of the Law, regularly inspect, supervise and track the implementation process to have solutions when necessary.

In particular, Ms. Thanh suggested that it is necessary to carefully review, especially administrative procedures, to ensure flexibility in management and operation and meet practical requirements, including content related to payment of health insurance costs.

According to Ms. Thanh, the policy of universalizing health insurance examination and treatment is new, complex, and groundbreaking. The process of converting from 4 levels to 3 levels of health insurance examination and treatment affects the level of health insurance benefits and the initial registration for health insurance examination and treatment of people with health insurance cards, so it is necessary to anticipate problems arising in practice to stipulate in the law issues of principle, creating a flexible and feasible mechanism to operate the new policy, promptly handling arising problems.
