According to Minister of Science and Technology Nguyen Manh Hung, the Law on High Technology identifies types of technology and technology products that need to be prioritized for development, while the Law on Technology Transfer regulates the transfer, commercialization and management of technology, including high technology.
The two laws have a clear relationship of roles. The High Technology Law is the law that defines the subjects for priority development policies. The Technology Transfer Law is the law that regulates activities.
Minister of Science and Technology Nguyen Manh Hung explained the opinions raised by National Assembly deputies.
"The goal of amending these two laws is to help Vietnam truly have high technology and create a technology market," said Minister Nguyen Manh Hung.
Regarding the Law on High Technology, according to the Minister, high technology is not only a field of investment incentives, but also a strategic pillar of the economy, national defense, security and national competitiveness, high technology is also national sovereignty . This is a change in our Party's perception. Vietnam has announced a list of 11 strategic technology groups that Vietnam must master. This is also a declaration of Vietnam's autonomy and self-reliance in technology.
This revised Law on High Technology aims to institutionalize these views and classify high technology, strategic technology, and core technology for development management.
High technology is for national development; strategic technology is a national priority for self-reliance, requiring special policies; core technology is what we must do and keep.
According to the Minister, amending the Law on High Technology in the direction of adding 4 breakthroughs, demonstrates our Party's new thinking on science and technology. One is adding the concept of strategic technology, paying attention to properly handling the relationship between high technology and strategic technology, core technology. Two is adding preferential policies to increase the localization rate, increase the technology content of Vietnam. Shift from processing and assembling to researching, designing and creating high-tech products in Vietnam. Three is focusing on national goals and strategies, such as double-digit growth, labor productivity, and technological autonomy. Four is forming a high-tech urban area as a place to live, work and create in a high-tech environment.
Regarding some specific contents, the mechanisms and policies for high technology in the current law will continue to be maintained and incentives will be increased if FDI increases the localization rate of technology transfer with research and development activities in Vietnam.
The Law formulates special policies to strongly promote strategic technology autonomy, such as direct task assignment, specific mechanisms in decoding, purchasing technological know-how, establishing special experimental zones exclusively for strategic technology, and special procurement of strategic technology and strategic products.
Regarding the Law on Technology Transfer, the Minister said that the main goal of this amendment is to form a substantial technology market, technology transfer becomes a diffusion and commercialization mechanism to bring technology into production faster and stronger.
Shift from controlling transfer to promoting innovation, reducing administrative procedures, shifting from pre-control to post-control, creating a transparent mechanism, developing intermediary organizations for businesses to quickly import new technology, master and innovate technology. Shift from thinking about technology as machines and equipment to thinking about technology as knowledge, data, algorithms, software, artificial intelligence and considering all as equal transfer objects.
Regarding some specific contents, the Law on Technology Transfer expands new technology subjects and new forms of technology transfer. In addition to the rights of ownership and use, it expands derivative technologies, co-developed technologies, temporary technology transfer and transfer based on results, and allows a sandbox for technology transfer.
Add new technology objects, such as: Design, algorithms, models, data, AI, have a new approach to invisible technology objects. Decentralization of technology appraisal to localities must be accompanied by the design of a unified national set of criteria, the publication of information on technology appraisal and the Central Government has the right to supervise, post-audit and veto.
To strongly promote the science and technology market, the Law on Technology Transfer provides additional regulations on the development of intermediary organizations, brokers, consultants, technology assessment, price appraisal, supply-demand connection. Organizing trading floors and budget support for technology innovation.
In addition, both laws are amended to strengthen state management capacity, carry out comprehensive digital transformation to monitor, compile statistics, measure, and publicly announce the effectiveness of high-tech operations and technology transfer.
According to Minister Nguyen Manh Hung, to ensure flexibility and quick adaptation to technological changes, specific and quantitative regulations will be assigned to the Government. The State always retains the right to post-check technology with strong sanctions to avoid inflating technology prices and bringing outdated and environmentally harmful technology into Vietnam.
