Late in the morning of November 13, explaining and clarifying some opinions of National Assembly deputies interested in discussing the Law on Civil Servants (amended), Minister of Home Affairs Do Thanh Binh said that the policy is to allow civil servants to sign labor contracts and work contracts to create a mechanism to connect human resources between the public and private sectors.
However, first of all, civil servants must ensure that they perform well and complete their assigned duties and tasks, and have specific mechanisms to avoid conflicts of interest and avoid taking advantage of policies that affect transparency and the reputation of the unit where they work.

At the discussion session in the hall, many delegates were also interested in the method of evaluating civil servants, how to ensure that the evaluation must be substantial based on the principle of being linked to products and results of task performance; quantitative, objective, multidimensional...
With these requirements, Minister Do Thanh Binh said that the ministry will review and adjust to stipulate principles and authority for regular, continuous, multi-dimensional assessment based on results, quality of public career services and people's satisfaction; apply digital technology , build a national database on civil servants to ensure publicity and transparency in assessment, management and development of civil servants.
Some opinions of the deputies suggested that the organization and operation of public service units should not be regulated by the Law on Organization and Operation of Public Service Units. The leader of the Ministry of Home Affairs said that this is also the content that the Government should consider carefully before reporting to the National Assembly Standing Committee and submitting to the National Assembly. The Law on Public Employees regulates the recruitment, use and management of civil servants, while public service units are a matter of organizational structure.
However, according to Minister of Home Affairs Do Thanh Binh, the provisions in Articles 9 and 10 of the 2010 Law on Public Employees (amended and supplemented in 2019) on public service units serve as the basis for the Government to regulate the organization and operation of public service units. Therefore, while the law on the organization and operation of public service units has not yet been promulgated, the drafting agency requests the National Assembly to keep the provisions in the draft Law to serve as a basis for sub-Law documents to be promulgated and maintain stability in the operation of public service units.

Currently, the Government is urgently directing research and summarizing practices to develop laws to regulate public service units, to be submitted to the National Assembly in the coming time.
At this morning's discussion, the content of innovating the mechanism of managing and using civil servants according to job positions attracted the attention of many delegates because it is related to innovating the mechanism of managing and using civil servants. Regarding this content, the head of the Ministry of Home Affairs said that he would review the provisions on recruitment grounds; recruitment principles; recruitment methods; and the provisions on job positions in the draft law.
In addition to the above contents, Minister of Home Affairs Do Thanh Binh said that the drafting agency recorded all opinions on contents such as civil servant discipline, training, fostering, emulation, rewards, exclusion, exemption from responsibility of civil servants, termination of employment, retirement, regulations related to rights and obligations of civil servants to review and adjust to ensure consistency, synchronization, feasibility, creating conditions for building and developing a team of increasingly professional civil servants, operating effectively, serving the needs of the people and society better and better.
