Appraisal of the Resolution on the establishment and management of the National Database on handling administrative violations

(Chinhphu.vn) - On the afternoon of October 31, Deputy Minister of Justice Nguyen Thanh Tinh chaired the Council for Appraisal of the draft Resolution of the Government on the establishment and management of the National Database on handling administrative violations.

Presenting the draft Resolution on the construction and management of the National Database on handling administrative violations, Director of the Department of Inspection of Legal Normative Documents Ho Quang Huy said that the Resolution was issued to transfer the task of constructing and managing the National Database on handling administrative violations from the Ministry of Justice to the Ministry of Public Security when the provisions of the Law on Handling Administrative Violations and documents detailing the implementation of the Law had not yet been amended and supplemented.

The Resolution stipulates the responsibility for building and managing the National Database on handling administrative violations. Accordingly, the Resolution consists of 7 Articles, including regulations on the scope of regulation and applicable subjects; regulations on the responsibilities of ministries, branches and localities; regulations on amending and supplementing a number of articles of Decree No. 118/2021/ND-CP detailing a number of articles and measures to implement the Law on Handling Administrative Violations (amended and supplemented by Decree No. 68/2025/ND-CP and Decree No. 190/2025/ND-CP); regulations on amending and supplementing a number of articles of Decree No. 20/2016/ND-CP regulating the National Database on handling administrative violations...

Commenting at the appraisal session, Mr. Hoang Nguyen Phuong, an expert from the Ministry of Home Affairs, suggested considering adding provisions to this Resolution and at the same time defining the principles of connection and data sharing between the national database on administrative violation handling and other national databases according to the National Digital Architecture Framework (version 1.0) issued by the Ministry of Science and Technology on October 8, 2025 to ensure connectivity and consistency in the digital Government data infrastructure.

At the same time, it is recommended to consider adding regulations on agencies and units to update data on the national data integration and sharing platform, the data sharing and coordination platform of the National Data Center, the Digital Government Architecture Framework; ensure information security and protect personal data according to regulations; add regulations on the Ministry of Justice being responsible for guiding and inspecting legal procedures for data in the National Database on handling administrative violations to ensure consistency in law enforcement to ensure accuracy and consistency in administrative content.

Along with that, Mr. Pham Minh Hieu, representative of the Ministry of Science and Technology, proposed to supplement the content of the regulation assigning the Ministry of Public Security to build and operate the National Database on handling administrative violations nationwide to serve the work of handling administrative violations, at the same time, fully integrating functions such as making electronic records of handling administrative violations; electronic decisions on handling administrative violations; updating and sharing data on handling administrative violations among ministries, branches, localities... to ensure modernization and simplification of handling administrative violations.

At the review session, the Council members basically agreed with the draft Resolution. However, the members requested the presiding agency to carefully review the legal system, ensuring the replacement of all contents on the authority to build, manage and operate the National Database on handling administrative violations in relevant legal documents; consider having regulations to transition or supplement the content of Article 2 of the draft Resolution to handle cases of continued use and conversion of data and use of the National Database on handling administrative violations built by ministries, branches and localities into the National Database on handling administrative violations.

Concluding the appraisal session, Deputy Minister of Justice Nguyen Thanh Tinh requested the drafting agency to accept and explain the comments of the Appraisal Council members according to regulations. At the same time, review the language and legislative techniques to complete the draft Resolution. After accepting the Council's comments and completing the contents, the Resolution dossier is eligible to be submitted to the Government.
