Presenting the draft Resolution on the construction and management of the National Database on Administrative Violations, Director of the Department of Legal Document Inspection Ho Quang Huy stated that the Resolution was issued to transfer the task of building and managing the National Database on Administrative Violations from the Ministry of Justice to the Ministry of Public Security before the amendment and supplementation of the Law on Handling Administrative Violations and its implementing regulations.
The Resolution stipulates the responsibilities for building and managing the National Database on Administrative Violations. Accordingly, the Resolution consists of 7 Articles, including provisions on the scope of application and subjects covered; provisions on the responsibilities of ministries, sectors, and localities; provisions on amending and supplementing some articles of Decree No. 118/2021/ND-CP detailing some articles and measures for implementing the Law on Handling Administrative Violations (amended and supplemented by Decree No. 68/2025/ND-CP and Decree No. 190/2025/ND-CP); provisions on amending and supplementing some articles of Decree No. 20/2016/ND-CP regulating the National Database on Administrative Violations…
During the review session, Mr. Hoang Nguyen Phuong, a specialist from the Ministry of Interior, suggested considering supplementing this Resolution with regulations and establishing principles for connecting and sharing data between the national database on administrative violations and other national databases according to the National Digital Master Architecture Framework (version 1.0) issued by the Ministry of Science and Technology on October 8, 2025, to ensure interoperability and uniformity in the digital government data infrastructure.
At the same time, it is proposed to consider adding regulations requiring agencies and units to update data on the national data integration and sharing platform, the data sharing and coordination platform of the National Data Center, and the Digital Government Architecture Framework; ensuring information security and protecting personal data as prescribed; and adding a regulation that the Ministry of Justice is responsible for guiding and inspecting legal procedures regarding data in the National Database on Administrative Violations to ensure uniformity in the application of law and to guarantee the accuracy and consistency of administrative content.
In addition, Mr. Pham Minh Hieu, representing the Ministry of Science and Technology, proposed adding a provision assigning the Ministry of Public Security the responsibility of building and operating a unified national database on administrative violation handling nationwide to serve the work of handling administrative violations. This database should fully integrate functions such as creating electronic administrative violation reports; issuing electronic administrative violation decisions; and updating and sharing administrative violation data among ministries, sectors, and localities, ensuring the modernization and simplification of administrative violation handling.

At the review meeting, the Council members generally agreed with the draft Resolution. However, the members requested the lead agency to carefully review the legal system, ensuring that all provisions regarding the authority to build, manage, and operate the National Database on Administrative Violations in relevant legal documents are replaced; and to consider transitional provisions or the addition of content to Article 2 of the draft Resolution to address cases of continued use and data conversion and use of the National Database on Administrative Violations already built by Ministries, sectors, and localities into the National Database on Administrative Violations.
Concluding the review session, Deputy Minister of Justice Nguyen Thanh Tinh requested the drafting agency to incorporate and address the comments from the members of the Review Council as per regulations. He also requested a review of the language and legislative techniques to finalize the draft Resolution. After incorporating the Council's feedback and completing the necessary content, the Resolution will be ready for submission to the Government.
