Decree No. 140 issued on June 12 stipulates the division of authority of two-level local authorities in the field of state management of the Ministry of Construction .
In particular, the Decree divides the authority when organizing two-level local government in the fields of construction activities; housing, real estate business; architecture, urban development, technical infrastructure; and transportation.
According to the Decree, the authority to grant construction permits in the 2014 Construction Law (amended and supplemented in 2020) will be exercised by the People's Committee at the commune level.
The Decree clearly states that the responsibility for receiving applications to buy, rent or hire-purchase social housing from resettled people; checking and confirming the subjects; making a list of households, individuals and families eligible to buy, rent or hire-purchase social housing is carried out by the People's Committee at the commune level.
The responsibility for confirming the subjects in the application whose names are on the land use right certificate and property ownership certificate attached to the land of the district-level land registration office/branch will be carried out by the land registration office/branch of the land registration office located at the commune-level administrative units or inter-commune and ward areas where social housing projects are located.
Meanwhile, the responsibility for assessing and confirming the subjects, housing conditions, income conditions, and conditions for preferential loans of the Department of Natural Resources and Environment and district-level authorities will be carried out by the Department of Agriculture and Environment and commune-level authorities.
The responsibility for publicly announcing information related to social housing construction investment projects provided by investors by the district-level People's Committees previously will be carried out by the commune-level People's Committees where the projects are implemented.
The organization of enforcement and settlement of complaints related to enforcement by the District People's Committee are also decentralized to the Commune People's Committee for implementation.
Along with that, the commune level is also responsible for implementing state management of real estate business.
This Decree takes effect from July 1, 2025 and expires from March 1, 2027, except for some cases such as ministries and ministerial-level agencies reporting to the Government for proposal and the National Assembly decides to extend the application period.
