Decree No. 101/2025/ND-CP amending conditions and procedures for opening specialized airports.
In particular, Decree No. 101/2025/ND-CP amends and supplements Clause 2, Article 6 of Decree No. 42/2016/ND-CP regulating the management of construction of specialized airports.
According to the new regulation, the Chief of the General Staff decides to approve the detailed design for the construction of a specialized airport. Previously, Decree No. 42/2016/ND-CP stipulated that "The Chief of the General Staff decides to approve the detailed design for the construction of a specialized airport after reaching agreement with the Ministry of Transport ".
Conditions for opening a dedicated airport
Decree No. 101/2025/ND-CP also amends and supplements Clause 1, Article 10 of Decree No. 42/2016/ND-CP on conditions for opening specialized airports:
- Serving the strategy of protecting the Fatherland, developing the economy and society;
- Comply with relevant legal provisions on airspace management, land management, environment, water resources, water surface areas, sea surface areas, airspace management, no-fly zones, restricted flight zones;
- The airport owner has been granted a Certificate and a Registration for specialized airport operations for the airport proposed to be opened to serve the purpose of regularly operating commercial flights.
Amending procedures for opening specialized airports on land and water
Amending regulations on procedures for opening specialized airports on land and water, Decree No. 101/2025/ND-CP stipulates that the application dossier includes :
- Application for opening a specialized airport on land or water according to Form No. 01 of the Appendix issued with this Decree;
- General airport layout drawing, detailed airport layout drawing; clearly showing construction elevation, airport reference point, size, basic direction of runway, taxiway, aircraft parking lot and other airport infrastructure works; airport construction land boundary;
- Description of management, exploitation, security and aviation safety assurance, environmental protection, water resources, flight operations organization, and flight information coordination.
Procedure for handling requests :
- Organizations and individuals requesting to open specialized airports on land or water shall submit 01 set of documents as prescribed above to the Department of Operations, General Staff in person or via postal service or online via the National Public Service Portal or the Ministry of National Defense's Administrative Procedure Information System. In case of submitting documents online, send electronic copies or electronic copies of the above-mentioned document components;
- Within 10 working days from the date of receiving a complete and valid dossier as prescribed, the Department of Operations, General Staff is responsible for appraising, checking, and reporting to the General Staff with a written agreement from the Ministry of Construction and the People's Committee of the province where the specialized airport on land or water is opened;
In case the dossier is invalid, within 5 working days from the date of receiving the dossier, the Department of Operations, General Staff shall issue an electronic document requesting the organization or individual requesting to open a specialized airport on land or water to complete the dossier according to regulations;
- Within 7 working days from the date of receipt of the request document from the General Staff, the Ministry of Construction, and the Provincial People's Committee shall send a written response to the General Staff;
- Within 10 working days from the date of receipt of the unified document from the Ministry of Construction, the Provincial People's Committee and the General Staff shall issue a decision to open a specialized airport;
In case of disapproval, the General Staff shall reply in electronic form, stating the reasons;
In case an organization or individual requests to receive results via email, it will be sent via email to the organization or individual.
Procedures for closing specialized airports on land and water
In addition, Decree No. 101/2025/ND-CP also amends and supplements Clause 2, Article 12 of Decree No. 42/2016/ND-CP on procedures for closing specialized airports on land and water.
According to the new regulations, the owner of a specialized airport on land or water must submit 01 set of documents as prescribed to the Department of Operations, General Staff directly or via postal service or online via the National Public Service Portal or the Ministry of National Defense's Administrative Procedure Information System. In case of submitting documents online, send an electronic copy or electronic copy of the document components as prescribed.
In case the dossier is invalid, within 5 working days from the date of receipt of the dossier, the Department of Operations, General Staff shall issue an electronic document requesting the airport owner to complete the dossier according to regulations.
Within 7 working days from the date of receiving a complete and valid dossier, the General Staff shall issue a decision to close a specialized airport on land or water after receiving a written agreement from the Ministry of Construction and send an electronic document to the airport owner, relevant agencies, organizations and individuals.
In case an organization or individual requests to receive results via email, it will be sent via email to the organization or individual.
The Decree clearly states that for dossiers requesting to open, reopen, close, or temporarily close specialized airports submitted to the Department of Operations, General Staff before the effective date of Decree No. 101/2025/ND-CP (June 23, 2025), the settlement shall be implemented in accordance with the provisions of Decree No. 42/2016/ND-CP dated May 15, 2016 of the Government stipulating the conditions, order, and procedures for opening and closing specialized airports.
