
Need to be "legitimate" soon
Since 2018, Hanoi city has implemented the Prime Minister's decisions on piloting the model of Urban Construction Order Management Team under the People's Committees of districts, towns and cities.
According to the assessment of the Hanoi Department of Construction, after implementing this pilot model, the management of construction order in the city has had many positive changes. The summary of the handling of construction order violations in recent years by the Department of Construction Inspectorate shows that complicated cases of construction order violations that have caused public outrage have gradually been limited.
According to the latest report, in 2024, in the city, some localities did not have any construction works violating construction order such as Hai Ba Trung district, Son Tay town, or had a low rate of construction works violating (under 1%) such as Long Bien, Ha Dong, Ba Dinh, Tay Ho, Hoang Mai districts; Hoai Duc, Phuc Tho, Thanh Tri, Thuong Tin districts. Notably, compared to the same period in 2023, the total number of construction works in 2024 increased by 7,061 works, but the rate of construction works violating decreased.
However, according to the representative of the Department of Construction, this pilot model also has some shortcomings, such as difficulties in organizing the apparatus and operations. In particular, the organization of the Urban Construction Order Management Team is unstable, there are no regulations; officers and civil servants do not have stable mindsets to work.
Vice Chairman of the People's Committee of Nam Tu Liem District Nguyen Thanh Binh said that after a 7-year pilot period, it is time for the Urban Construction Order Management Team to be "legitimated" and equipped with stronger sanctions.
Meanwhile, with a purely agricultural district with a large area and a large number of administrative units like Chuong My, the leader of the district People's Committee said that the assigned staff of the construction order management unit is 21 people but in reality, it is 16 people, causing many difficulties in operation. Therefore, the district has repeatedly requested to increase the staff of this force.
Transformation to meet higher demands
According to former Director of Hanoi Department of Construction Vo Nguyen Phong (now Director of Department of Industry and Trade), in recent years, the Urban Construction Order Management Team under the People's Committee at district level has promoted many positive effects. However, the city always has potential risks of violating construction order, especially related to multi-family and multi-storey buildings. Therefore, this model needs to be summarized and adjusted soon to continue to promote its role further.
During the period from now until the completion of the arrangement and reorganization of administrative units at all levels and the construction of a 2-level local government organization model, the city has issued instructions on strengthening the management of construction order in the area. Along with that, authorities at all levels continue to manage and maintain the effective operation of the Urban Construction Order Management Team under the District People's Committee according to the pilot model until an official decision is made.
At the same time, all levels of government are also fully responsible before the law, the City Party Committee and the City People's Committee for the situation of construction order in the area under their management. It can be seen that the management of urban construction order in the entire city is ensured to be maintained, discipline and order are tightened at all times and stages, not allowing individuals and organizations to take advantage of the transition period to intentionally violate.
As the administrative boundaries of commune-level units are expanded and the population increases, the management of construction order in the new area is expected to become more complicated. This reality places higher demands on the upcoming organization of the team of urban construction order management officers at the commune level. In that spirit, the model of the converted urban construction order management agency is also expected to thoroughly overcome the existing problems and difficulties to better fulfill the assigned functions and tasks.

Need to decentralize and delegate authority thoroughly

When the organization of new administrative units is completed, some tasks at the district level will have to be transferred to the commune level. At the new commune levels, with expanded administrative boundaries and increased population, the situation of violations of construction order will certainly become more complicated. Therefore, a specialized unit for construction order management at the commune level should be established with thorough decentralization and delegation of authority.
Recently, in concretizing the Capital Law, the city has transferred some tasks and powers to the commune level. For example, the chairman of the commune-level People's Committee has the authority to apply measures to request the suspension of electricity and water services in some cases of construction order violations. To streamline the apparatus, the city needs to continue to clearly define and decentralize the power to the commune-level government to directly handle tasks arising locally.

Minimize the occurrence of violations

With rapid urbanization and high population growth, the demand for land and housing of the people of the capital as well as in Hoang Mai district is increasing. Regarding violations of construction order, from 2020 to present, Hoang Mai district has handled 119 cases; prevented and handled over 800 cases of land violations with an area of over 30 hectares; reviewed the responsibilities of 14 groups and 43 individuals for violations. The district has issued many directives, established regular and surprise inspection teams, focusing on "hot" areas, and resolutely not allowing new violations to arise.
From now until June 30, the district still has many potential complications in land management, construction order, and procedures for granting certificates of house ownership and land use rights to people. Therefore, the District People's Committee focuses on directing units to regularly inspect, monitor, maintain daily reporting, and promptly inspect and handle violations (if any).

Avoid functional overlap

Through following the press, I have noticed that recently prominent and newly arising cases of construction order violations have been greatly limited.
The city has also issued many strong sanctions, which have been agreed upon by the people, such as requiring the suspension of electricity and water services at constructions that violate urban construction order.
However, in reality, violations of urban construction order can still occur silently in many sophisticated ways. Therefore, in the coming time, when new administrative boundaries at the commune level are established, the force managing urban construction order needs to avoid overlapping functions or shirking responsibilities.
In addition, to prevent new violations of construction order, the enforcement force needs to be given stronger authority. Commune-level government leaders are fully responsible for managing construction order.
