Prime Minister Pham Minh Chinh: Resolving problems in the legal document system is a practical requirement

On the morning of July 8, Prime Minister Pham Minh Chinh , Head of the Steering Committee for reviewing and handling difficulties in the system of legal documents (Steering Committee) chaired the first meeting of the Steering Committee to assess the situation, determine requirements and objectives; unify viewpoints, principles, scope and content of reviewing and handling difficulties in the system of legal documents.

Also attending were Deputy Prime Ministers, Ministers, leaders of ministries and branches who are members of the Steering Committee.

Previously, Prime Minister Pham Minh Chinh decided to establish a Steering Committee to review and handle problems in the system of legal documents, headed by the Prime Minister, to implement resolutions and conclusions of the Party, National Assembly, and Government on building and perfecting legal institutions and to meet practical requirements.

After listening to the opinions and concluding the meeting, Prime Minister Pham Minh Chinh welcomed the enthusiastic, responsible, and timely opinions of the delegates, the preparation work of the Ministry of Justice and relevant agencies; emphasized the requirement for the Steering Committee's activities to "clearly define the people, the work, the responsibilities, the time, the products, and the results"; and promptly establish a Steering Committee support team consisting of members with sufficient capacity, qualifications, and enthusiasm, who are department-level officials, experts, and researchers, headed by a Deputy Minister of Justice.

According to the Prime Minister, the review and handling of problems in the system of legal documents have a full political basis, legal basis, and practical basis. In particular, the political basis and legal basis are the Resolution of the 13th National Party Congress, Conclusion No. 64-KL/TW dated October 18, 2023 of the 8th Conference of the 13th Party Central Committee on socio-economic development in 2023-2024; Conclusion No. 19-KL/TW dated October 14, 2021 of the Politburo on the orientation of the Law-making Program for the 15th National Assembly; Resolution No. 101/2023/QH15 and Resolution No. 110/2023/QH15 of the National Assembly and other resolutions and conclusions of the Central Committee, the Politburo, the Secretariat, and the National Assembly.

Along with that, the Government also issued Resolution No. 82/NQ-CP dated June 5, 2024 on the regular meeting in May 2024, Resolution No. 93/NQ-CP dated June 18, 2024 on key tasks and solutions to promote growth, control inflation and stabilize the macro-economy, Resolution No. 97/NQ-CP dated June 24, 2024 on the thematic meeting on law-making in June 2024, which requires research and reporting to the Prime Minister to establish a Steering Committee to direct ministries, agencies and localities to review problems in legal regulations.

In particular, reviewing and handling problems in the system of legal documents is a requirement and demand of practice when the situation changes very quickly, many new problems arise, cannot be predicted, there are no regulations to regulate or there are problems that have been regulated but are overcome by practice.

The Prime Minister clearly stated the objective of reviewing and handling obstacles in the system of legal documents to contribute to overcoming the situation of avoidance, shirking, fear of mistakes, fear of responsibility, not daring to think, not daring to do, and stagnation among a number of cadres and party members; improving the investment and business environment, promoting decentralization, reforming administrative procedures, building a socialist rule-of-law state; contributing to the implementation of the goal of stabilizing the macro economy, controlling inflation, promoting growth, ensuring major balances of the economy and major goals according to the Resolution of the 13th National Party Congress.

“The viewpoint and principle of implementing the work is to focus on key points, towards decentralization, delegation of power, simplification of administrative procedures, and strengthening the responsibility of all levels and sectors; what is ripe, clear, proven to be correct in practice, effectively implemented, and agreed upon and supported by the majority, should be included in the law and continued to be implemented. For new issues, which do not yet have regulations or regulations that have exceeded practice, we should boldly pilot them, learn from experience while doing, and gradually expand, without perfectionism or haste,” the Prime Minister pointed out.

The Head of Government pointed out that the scope of reviewing and handling difficulties in the system of legal documents includes a number of laws that need to be amended most urgently to remove difficulties, obstacles, obstacles, and bottlenecks; laws that have a roadmap for amendment until 2025, according to the principle that the law is drafted by a ministry or sector, that ministry or sector will take the lead in monitoring, reviewing, and proposing; at the same time, consulting opinions and proposals from ministries, localities, businesses, and people.

According to the Prime Minister, the content of the review and revision focuses on promoting decentralization and authorization, with central ministries and branches focusing on performing state management tasks (building mechanisms, policies, laws, planning, inspection, supervision, rewards, and discipline), not doing specific tasks; cutting down and simplifying administrative procedures, removing overlaps and obstacles; eliminating requests, preventing harassment, etc. for people and businesses; clearing and effectively using all resources for development, taking public investment and state resources to lead and activate all other legal resources, including foreign investment.

Specifying that after reviewing, it is proposed to develop a law amending many laws in a simplified order and procedure to handle the problems, and submit it to the National Assembly as soon as possible. The Prime Minister requested that the heads of ministries, branches, agencies, and localities directly direct the work of building and perfecting laws and institutions within their management scope; at the same time, arrange cadres with sufficient capacity, qualifications, enthusiasm, passion for the work and pay attention to the regime and policies suitable for the team of cadres doing legal work.
