Implementing Circular 29, are teachers allowed to teach extra classes during the summer?

Explaining the above concerns, a representative of the Ministry of Education and Training said that Circular 29 does not prohibit teachers from teaching extra classes during the summer. However, teachers who are allowed to organize extra classes outside of school and collect money from students during the summer break must comply with the accompanying requirements.

Teachers who teach extra classes during the summer must comply with the following conditions.

Specifically, it is necessary to register a business in accordance with the provisions of law. Publicly announce on the electronic information portal or post at the place where the tutoring facility is located the subjects that are organized to be taught; the duration of tutoring for each subject according to each grade level; the location, form, and time of organizing tutoring and learning; the list of tutors and the tuition fees before enrolling students in tutoring and learning classes.

Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach.

Teachers who are teaching at schools and participate in extra-curricular teaching must report to the principal about the subjects, location, form, and time of extra-curricular teaching.

According to the provisions of Article 4 of Circular 29, when organizing extra classes, teachers need to pay attention to the following cases where extra classes are not allowed:

Do not organize extra classes for primary school students, except in the following cases: art training, physical education, and life skills training.

Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned to teach by the school according to the school'seducational plan.

Teachers in public schools are not allowed to participate in the management and operation of extra-curricular tutoring, but can participate in extra-curricular tutoring. Teachers must not force students to take extra classes in any form; they must sign a transparent commitment with parents about tuition fees, duration, teaching content, etc.

Are teachers paid for tutoring and exam preparation?

Some Departments of Education and Training in their guidelines for organizing upcoming summer activities have emphasized instructing schools to absolutely not organize extra classes for students in any form.

However, in many high schools, during the summer break (June), teachers still have to review for 12th graders to prepare for the high school graduation exam to achieve the best results. The Department of Education and Training of the provinces also requires educational institutions to make plans to review culture and improve knowledge for weak and poor students...

So, what kind of compensation are given to teachers who are required to "teach extra" during the summer?

Mr. Vu Minh Duc, Director of the Department of Teachers and Educational Managers (Ministry of Education and Training), said that to ensure consistency with Circular No. 29, Circular 05 on the working regime of general education teachers that the Ministry of Education and Training has recently issued has added regulations such as: teachers participating in teaching students to review for entrance exams and graduation exams according to regulations, 1 direct teaching period (or online) is converted to 1 standard period.

Teachers who participate in tutoring students whose final semester study results are below the school's educational plan will have 1 direct teaching period converted to a maximum of 1.5 standard periods.

The school principal shall base on the scale of the organization of the extra class and the capacity of the students in the remedial class or extra class to specifically determine the conversion of teaching hours after receiving the consensus of the school council.

"This is an important legal basis for schools to calculate payment for teachers, ensuring policies and regimes for teachers when they participate in extra teaching in schools," said Mr. Duc.

According to Mr. Duc, Circular 05 also adds clearer regulations on summer vacation for teachers, principals, and vice principals to ensure the right to rest for all teachers.

Many opinions say that if teachers take advantage of summer vacation time to teach extra classes, it will not only affect the meaning of teachers' rest and labor regeneration time, but students will also not have a complete summer vacation.
