
Accordingly, the People's Committee of Ho Chi Minh City has approved the proposal of the Department of Construction, unanimously applying Decree No. 108/2024 regulating the management, use and exploitation of houses and land that are public assets not used for residential purposes, assigned to organizations with the function of managing and trading houses, and local authorities for management and exploitation.
Units and organizations assigned to manage and exploit commercial and service floors belonging to public assets in apartment buildings are responsible for developing effective and appropriate exploitation plans according to approved designs and ensuring that at least 1/3 of the area is reserved for priority for households and individuals resettled in rented apartments through auction.
The People's Committee of Ho Chi Minh City assigned the Department of Construction to review and classify commercial and service floors in resettlement apartments. In cases where the apartment has been assigned to an organization with the function of managing and trading houses, it will continue to manage and exploit them according to Decree 108 without having to carry out procedures for handing over houses and land. In cases where the apartment has not been assigned for management and exploitation, a dossier will be prepared and submitted to the People's Committee of Ho Chi Minh City to assign the Center for Housing Management and Construction Appraisal to manage and exploit them according to the provisions of Decree 108.
The People's Committee of Ho Chi Minh City assigns organizations assigned to manage and exploit trading and service floors based on the provisions of Article 40 of Decree No. 95/2024 and Decree No. 108 to manage the amount of money collected from exploitation activities according to regulations.
