According to Article 4 of the Decree, the People's Committees at the commune level (including communes, wards, towns, and special zones) will directly conduct state inspections of measurement within their management areas. The inspection contents include: measurements, measuring instruments, and quantities of prepackaged goods, specifically regulated in Clause 3, Article 46 of the Law on Measurement and Clause 4, Article 13 of Decree No. 86/2012/ND-CP.
Not only that, Article 5 of the Decree also assigns the People's Committee at the commune level to perform the function of state management of product and goods quality in the locality. That means, based on Clause 3, Article 33 of Decree No. 132/2008/ND-CP, the People's Committee at the commune level will perform the following tasks: Propagating, disseminating and organizing guidance on the implementation of laws on product and goods quality according to the provisions of law; Participating in the inspection of the quality of goods in circulation on the market; Handling violations of the law on goods quality according to authority.
Notably, this is the first time the commune level has been assigned tasks such as: Establishing an inspection team to measure and monitor the quality of goods; handling complaints and denunciations related to the quality of products and goods right at the facility.
Decentralizing the inspection of measurement and quality of goods to the commune level not only helps detect violations early, but also reduces pressure on the provincial level, while enhancing the ability to respond quickly to problems arising right at the local level. Regular and unscheduled inspections help prevent fraud in measurement and protect consumer rights.
In fact, most consumer goods, from food, agricultural products to pre-packaged goods, are produced, distributed and consumed locally. Therefore, checking right at the commune level is not only convenient but also effective in preventing commercial fraud early.
It can be seen that Decree No. 132/2025/ND-CP opens up opportunities to establish a mechanism for product inspection and supervision right at the origin, where the product begins to circulate and reaches consumers. This is especially meaningful in the context of the Government promoting the digital transformation program, developing OCOP products, local agricultural products and promoting domestic consumption.
Decentralizing the inspection of measurement and quality of products and goods to the commune level is a correct and inevitable direction, in line with the trend of modern administration and the need to protect consumers from the grassroots level. For that to become a reality, it is necessary to have a systematic and synchronous approach between empowerment and empowerment, between legal regulations and implementation practices. Only when the commune level is truly empowered with enough power and authority, will the management of measurement and quality of products and goods truly go into depth, contributing to building a transparent and fair market and protecting Vietnamese brands right from the local front line./.
