Specifically, Article 26 of the Law on Teachers (recently promulgated by the National Assembly and effective from January 1, 2026) stipulates the retirement regime for teachers as follows:

“1. The retirement age of teachers shall comply with the provisions of the Labor Code and other relevant legal provisions, except for the cases specified in Clause 2 of this Article and Article 27 of this Law.

2. Teachers in preschool education institutions, if they wish, can retire at an age lower than the retirement age of employees under normal conditions, but not more than 5 years. In case they have paid social insurance for 15 years or more, the percentage of pension benefits due to early retirement will not be reduced.

Article 169 of the Labor Code issued in 2019 stipulates the retirement age as follows:

“The retirement age of employees in normal working conditions will be adjusted according to the roadmap until reaching 62 years old for male employees in 2028 and 60 years old for female employees in 2035.

From 2021, the retirement age of employees in normal working conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees; then, each year it increases by 3 months for male employees and 4 months for female employees.

Accordingly, by 2026, the retirement age of employees in normal working conditions is 57 years old for female employees and 61 years and 6 months old for male employees.

According to the Law on Teachers, from January 1, 2026, preschool teachers will be able to retire before the age of 5 if they wish. That means, female preschool teachers who are 52 years old in 2026 can retire.

In addition, the Law on Teachers also stipulates the retirement regime at an older age for teachers in public educational institutions in Article 27.

Specifically: “ 1. Subjects who can enjoy retirement benefits at an older age include teachers with the title of professor, associate professor or doctoral degree and teachers working in specific specialized fields and industries.

2. The retirement regime at an older age is implemented when the educational institution has a need; the teacher is healthy enough, volunteering and meeting the standards and conditions of the educational institution.

3. Retirement time at higher age is regulated as follows:

a) Not older than 5 years for teachers with a doctoral degree;

b) Not older than 7 years old for teachers with the title of associate professor;

c) Not older than 10 years for teachers with the title of professor.

4. During the period of implementing the retirement regime at a higher age as prescribed in Clause 3 of this Article, teachers shall not hold management positions.

5. The Government shall detail the process and procedures for retirement at an older age; retirement at an older age for teachers in specific specialized fields and sectors.
