The information was shared at a workshop to collect opinions on the drafting of a Government decree amending and supplementing a number of articles of Decree 04/2021 and Decree 127/2021 regulating administrative sanctions in the field ofeducation , organized by the Ministry of Education and Training this morning (May 16) at Ho Chi Minh City University of Education.
Many concerns about regulations on penalties for violations of enrollment regulations
At the workshop, Dr. Quach Thanh Hai, Vice Principal of Ho Chi Minh City University of Technical Education, raised concerns about the regulations on penalties for violations of enrollment. Mr. Hai especially emphasized Article 8 of the Decree on the penalty for enrollment exceeding 3% of the enrollment target - a violation for which his school was administratively punished.
According to Dr. Quach Thanh Hai, with the current regulations, the trend of universities enrolling more students than their enrollment targets has decreased significantly. Because in addition to being fined, the violating unit will also have its enrollment targets for the following year deducted, and may even have its autonomy in determining enrollment targets revoked for a period of 5 years. In particular, the level of penalty for revoking the autonomy in determining enrollment targets for a period of 5 years is something that universities are very concerned about.
However, Dr. Hai said: "Enrollment has many risks, even though there is a margin of 3%, it is not a safe level for schools when enrolling. The probability of risk in enrollment is very high, not just calling 100 people can recruit exactly 100. Therefore, we should calculate the average number of many years instead of using the previous year's number to punish the following year."
"Another risk is that the current rate of over-enrollment is calculated by major or group of majors. Meanwhile, there are majors that do not recruit many students. For example, I have master's degree majors that only recruit 20 students. If we recruit just 1 person over-enrollment, the over-enrollment rate is already 5% - the risk of being penalized is very high," added the Vice Principal of Ho Chi Minh City University of Technical Education.
Regarding this, Dr. Le Hoang Dung, Vice Principal of the University of Social Sciences and Humanities (Ho Chi Minh City National University), also shared a real story related to difficult-to-recruit majors, such as archaeology, museum studies and some other majors. At that time, a major had only 6 applications while receiving 5 applications was already exceeding the quota, if receiving 1 more student, it could have exceeded the quota by 20%. Therefore, it is possible to exceed but according to a very small denominator, for example, less than 10 people will not be handled, for example, to have a more appropriate percentage calculation rate in penalizing enrollment quotas, especially for special majors that lack staff, are difficult to recruit and retain.

"The most important goal is to avoid the situation where schools chase quantity"
At the workshop, Deputy Minister of Education and Training Nguyen Van Phuc said that after many years of implementation, the decree has some points that are no longer suitable for the many changes in education, so amendments are necessary. The Deputy Minister suggested that the workshop focus on opinions to clearly identify inappropriate regulations that are no longer suitable and need to be adjusted; propose to supplement newly discovered violations in practice, loopholes in practice that are still overlooked, and those that cannot be handled without regulations and sanctions. From there, assess the appropriateness of the forms of sanctions, the level of sanctions and remedial measures for violations; consider the consistency and compatibility of relevant documents inside and outside the sector.
Regarding the concerns of universities about the level of penalties for violations in enrollment, Deputy Minister Nguyen Van Phuc said that there were years when more than 100 training institutions were penalized for violations in enrollment. A penalty regulation is issued, if there are few schools violating, it may be the fault of the schools; but if the number of schools violating is large, it is necessary to consider the practical suitability of the regulation. Therefore, the Deputy Minister suggested that universities should carefully comment on this point when amending and supplementing the decree.
With the current regulations, the Deputy Minister analyzed that for a major recruiting 300-400 students, the rate of exceeding 3% is high. On the contrary, there is a major at the master's level recruiting only 20 students, exceeding only 2 people, this rate is up to 10%. Therefore, it is necessary to consider developing regulations that are more suitable to reality. The most important purpose is to avoid the situation where schools are chasing after the number of students. Regulations need to be developed to ensure that schools are able to handle the situation of schools chasing after numbers. Because in reality, most schools do it seriously, but even in some cases, there are still schools chasing after the number of students.
"Schools deliberately recruit indiscriminately and rush to recruit large numbers of students. This needs to be checked and handled," the Deputy Minister of Education and Training emphasized.
