Allowing renovation and upgrading of existing buildings into private schools

The Chairman of the Ho Chi Minh City People's Committee directed the Departmentof Education and Training to preside over and coordinate with relevant departments, branches and localities in the process of appraising dossiers requesting the establishment of non-public schools and private schools in Ho Chi Minh City. When there are problems related to planning and land in the establishment of non-public schools, they will be considered and resolved as follows:

Firstly, investors are allowed to build new schools or renovate and upgrade existing buildings into schools on land with the purpose of being used for housing or other land use purposes but not subject to land use purpose change as prescribed in Clause 1, Article 121 of the 2024 Land Law and temporarily not "developing a land use plan to submit to competent authorities for approval" (not considering proposals for cases related to public assets and public land).

The deadline for applying the above-mentioned removal content is from the date of issuance of this document until the end of 2025 (only cases that have been completed by the Department of Education and Training and submitted before December 31, 2025 will be considered for settlement).

After the above deadline, the Department of Education and Training is assigned to evaluate the effectiveness, closely follow the adjusted contents of the circular and decree, arrange the apparatus and indicators, and propose to the City People's Committee to have appropriate and synchronous solutions.

Second, assign the Department of Education and Training to preside over and advise on solutions for each case; depending on the content of the problem, propose specific solutions and directions for each proposal to establish a private school.

In case of coordination in implementing the requirements and proposals and having the consensus and general support of the locality where the school is located (or school locations) and related departments and branches (Department of Agriculture and Environment, Department of Construction, City Fire Prevention and Fighting Police, etc.), then consider, synthesize and submit to the Chairman of the City People's Committee for decision on establishment.

Ensure unified coordination

In the document, the Ho Chi Minh City People's Committee directed some notes during the implementation and consultation process.

First, regulations on appropriate criteria ensure factors of objectivity, progress, deadlines, efficiency, etc. when specifying implementation policies.

Next, ensure coordination and consensus among relevant units and localities for specific cases. At the same time, proactively monitor and update relevant legal regulations, promptly advise competent authorities for consideration and direction.

The Ho Chi Minh City People's Committee requested the Department of Education and Training to note that each case of an investor proposing to establish a school must be assessed through a submission; the submission must ensure that there are enough members, with specific opinions as the agency in charge of synthesizing and submitting advice, and attach a draft decision on establishment or a draft document of the City People's Committee responding to the investor.

Regarding the documents submitted by the Department of Education and Training to the City People's Committee in Report No. 424/TTr-SGDĐT dated February 3, 2025 and Report No. 849/TTr-SGDĐT dated February 25, 2025, the City People's Committee assigned the Department of Education and Training to urgently guide investors to complete the project and submit it to the City People's Committee before May 25, 2025 for consideration and decision.

For investor dossiers that have been submitted and transferred by the City People's Committee Office or submitted to the Department of Education and Training for processing; or have been and are implementing procedures to propose school establishment, the Department of Education and Training shall review and issue specific instructions before June 30, 2025 for investors to coordinate implementation.

On that basis, the host shall have a document to collect opinions from each department, branch, and locality on each relevant content (except in cases where the investor has collected opinions from relevant departments and branches, which can be used for appraisal), from there synthesize the results, and advise the City People's Committee according to regulations.
