"Although the legal basis for Kevin Costner's request to evict his wife and children from his home is virtually nonexistent, this is still an extremely important issue for Christine," Rydell added in the filing, filed on June 14, according to Insider .
Rydell also reportedly criticized Costner's attorney - Laura Wasser - for not agreeing to delay the case's upcoming hearing, in which a judge will decide Baumgartner's fate.
The filing comes just a day after TMZ obtained documents from the 68-year-old actor asking the court to help evict his wife from their home.

Kevin Costner said that under their prenuptial agreement, former model Christine Baumgartner, 49, agreed to move out of their home within 30 days of filing for divorce.
Costner claims that Baumgartner filed for divorce on May 1, 2023, and was supposed to move out in early June but is still residing in the home.
The actor further accused Baumgartner of using the divorce as leverage to get him to agree to "various financial demands" despite giving her more than $1.2 million in post-divorce settlements.
In court filings, Kevin Costner even offered to pay $10,000 up front to cover her moving expenses as well as $30,000 a month in rent "as part of his child support obligations."

The Bodyguard star, who has a net worth of $250 million, also accused his ex-wife of secretly spending nearly $100,000 of his money, causing "irreparable harm".
Last month, Baumgartner decided to end her 18-year marriage, citing "irreconcilable differences." In court papers, she requested joint custody of her three children, Cayden, 15, Hayes, 14, and Grace, 12, but no spousal support.
Sources told Page Six at the time that Kevin Costner was "stunned" by his wife's decision to end their marriage and that he still "loves his wife and kids very much."
Despite rumors of infidelity as the main reason for the couple's split, a longtime friend of theirs said: "There was no cheating involved." Kevin Costner and Christine Baumgartner began dating in 1998 and married six years later. The actor had previously married Cindy Silva in 1978, divorcing her in 1994.
