According to the people of Tien Phuong commune, there are two areas of public land in the commune that have been occupied for many years. These are public lands that the locality previously leased for brick making and farming. After the lease term expired, although the contract was liquidated, the actual handover of the land to the locality was not seriously implemented. Therefore, most of the above land areas have been encroached upon by some households to build houses.
Regarding these cases, Tien Phuong commune land officer Nguyen Van Manh said that the commune previously leased 6,000 square meters of public land to Mr. Vu Dinh Chuyen to make bricks; in 2012, the land lease contract expired. However, due to many problems, the land handover procedures have not been thoroughly resolved. Currently, only a part of the area is the local water surface that is still preserved, while most of the land along the road has been encroached upon for construction.
Similarly, about 700 square meters of public land rented by Mr. Nguyen Van Tuyen for cultivation, but over time, has also been built on and is still not completely resolved. The reason is that the previous local land lease contracts had unclear terms, making it difficult to recover.
Regarding the records and the process of handling the two above-mentioned land areas, Head of the Department of Agriculture and Environment of Chuong My district Trinh Ba Thuong informed that on October 4, 2023, a representative of the Department of Natural Resources and Environment of the district (now the Department of Agriculture and Environment) worked with the People's Committee of Tien Phuong commune. The management records of the People's Committee of the commune show that more than 6,000m2 of land previously leased by Mr. Vu Dinh Chuyen was originally contracted by Dong Nanh Agricultural Cooperative to make bricks, and the contract expired in 2012.
However, Mr. Chuyen has continued to use the land until now and has not paid the land use fee, allowing some neighboring households to encroach. On April 12, 2013, the People's Committee of Tien Phuong commune issued Decision No. 37/QD-UBND on the cancellation of the contract. After consideration, the actions of Mr. Chuyen and some neighboring households constitute encroachment and land appropriation.
According to Mr. Thuong, the District Department of Agriculture and Environment has instructed and requested the People's Committee of Tien Phuong Commune to prepare a file to handle the violation and force the violator to return the encroached land. Given the complexity of the case, on November 15, 2021, the People's Committee of Chuong My District issued Document No. 338/UBND-BTCD transferring the case to the District Police for consideration and handling of the violation, but so far there have been no results.
The origin of the 700m2 area of Danh pond land that Mr. Nguyen Van Tuyen is using is a part of the land that Cao Son village previously leased to Mr. Tuyen for cultivation. In 2013, the village took it back to consolidate land and exchange plots. However, because Mr. Tuyen had built a project on this land, it led to difficulties in reclaiming the land.
According to the report of Tien Phuong Commune People's Committee, the land area that Mr. Tuyen is using is located within the administrative boundary of Ngoc Hoa Commune. Based on the reality, Mr. Tuyen has committed land occupation.
Head of the Department of Agriculture and Environment of Chuong My district Trinh Ba Thuong said that the unit has instructed and requested the People's Committee of Tien Phuong commune to provide information, coordinate with the People's Committee of Ngoc Hoa commune to establish a dossier to handle and re-manage the occupied land area. Since the beginning of 2024, the department has invited the People's Committees of Ngoc Hoa and Tien Phuong communes to meet to agree on a solution, and instructed the People's Committee of Ngoc Hoa commune to establish a dossier to handle violations according to regulations. Currently, the communes are continuing to implement.
Thus, it can be seen that the people's request to reclaim and completely handle the area of public land that has been encroached upon and illegally used is well-founded. This is necessary to ensure the respect of the law and to use land for the right purpose to avoid waste. We request the authorities of Chuong My district to completely resolve the matter.
