Kon Tum Provincial People's Committee has just issued Decision No. 48/2023/QD-UBND stipulating the land use quota for residential land and production land as a basis for determining households without residential land; without or lacking production land to implement the national target program on socio-economic development in ethnic minority and mountainous areas for the period 2021 - 2023, phase I from 2021 to 2025 in Kon Tum province.
The Decision stipulates that the subjects of application include: Firstly, poor ethnic minority households living in ethnic minority and mountainous areas, poor Kinh households living in extremely disadvantaged communes and extremely disadvantaged villages in ethnic minority and mountainous areas without residential land or with land but with an area smaller than the norm prescribed in this Decision.
Second, poor ethnic minority households living in ethnic minority and mountainous areas, poor Kinh households living in extremely disadvantaged communes and extremely disadvantaged villages in ethnic minority and mountainous areas living on agriculture and forestry do not have or lack more than 50% of production land area according to the norms prescribed in this Decision;
Third, agencies performing the function of managing and advising on state management of land, other relevant organizations and individuals.
Regarding the regulations and land quota for each household as a basis for determining households without land, the Decision clearly states that households do not have land or have land but the land area is less than 50 square meters.
In addition, the Decision also stipulates the production land quota for each household as a basis for determining households that do not have or lack production land as follows: For households with 1 to 4 people: Or production forest land: 1 ha; Or swidden land (including land for perennial crops, land for annual crops and other agricultural land): 0.5 ha; Or land for one-crop rice cultivation: 0.25 ha; Or land for two or more rice cultivation: 0.15 ha; Or land for aquaculture: 0.25 ha.
For households with 5 or more members, the rate specified in Clause 1, Article 3 of this Decision is multiplied by the coefficient 1.2.
In case a household has 2 or more types of production land as prescribed in Clause 1, Article 3, but all types of land have areas smaller than the minimum standard, it will be converted into production forest land to determine whether the household lacks production land. The conversion ratio is as follows: 1 m2 of upland land is converted into 2 m2 of production forest land; 1 m2 of single-crop rice field land and 1 m2 of aquaculture land is converted into 4 m2 of production forest land; 1 m2 of double-crop rice field land is converted into 6.66 m2 of production forest land.
The Provincial People's Committee assigns the People's Committees of districts and cities in Kon Tum province to be responsible for reviewing and deciding to approve the list of support beneficiaries specified in Point a and Point b, Clause 2, Article 1 of this Decision as a basis for implementing the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the 2021-2030 period, Phase I from 2021 to 2025 in Kon Tum province.
At the same time, assign the Department of Natural Resources and Environment of Kon Tum province to preside over and coordinate with the Ethnic Committee, People's Committees of districts, cities and relevant departments and branches to advise the Provincial People's Committee to resolve difficulties and problems in the process of implementing this decision.
This Decision takes effect from September 17, 2023 and replaces Decision No. 34/2018/QD-UBND dated December 11, 2018 of the People's Committee of Kon Tum province stipulating the average production land area for each household as a basis for determining households lacking production land in Kon Tum province.
According to preliminary statistics of the Kon Tum Provincial Ethnic Committee, from 2003 to early 2023, Kon Tum province has implemented policies on supporting production land and residential land for poor ethnic minority households and poor households in particularly difficult communes, villages and hamlets, achieving some results. Specifically, the total number of households supported with production land and residential land is 11,237, of which production land is supported for 7,206 households, residential land is supported for 4,031 households with a total cost of 108,047.4 million VND, of which the central budget is 34,998.7 million VND, the local budget is 2,961.7 million VND and credit loans are 70,087 million VND.
The effective implementation of the policy of supporting residential land and production land in Kon Tum province has created conditions for ethnic minority households to have land for stable housing, households supported with production land have gradually developed production on the supported land area to increase household income, reduce difficulties in food shortage, contribute to increasing local food production, hunger eradication and poverty reduction, and stabilize life. Some localities that no longer have production land to support have changed the content of support for production land to the form of support for job conversion, such as: raising cows and goats for breeding; purchasing machinery and agricultural tools for production.
