Strict control to prevent false advertising

The Government Office issued Notice No. 280/TB-VPCP dated June 4, 2025, concluding the conclusion of Deputy Prime Minister Bui Thanh Son, Head of the National Steering Committee 389, Head of the Working Group under Decision No. 950/QD-TTg dated May 17, 2025 of the Prime Minister at the Steering Committee meeting and working session with the People's Committee of Lang Son province on the peak of the fight against smuggling, trade fraud and counterfeit goods.

The announcement stated: In recent times, ministries, branches, localities and functional forces have made many efforts in the fight against smuggling, trade fraud and counterfeit goods and achieved important initial results, contributing to stabilizing and promoting production and business, increasing State budget revenue, ensuring security, order and legitimate rights of people and businesses.

Ministries, branches, members of the Prime Minister 's Working Group and localities have developed plans, established inspection working groups, and urged agencies, units, and functional forces to step up the fight to prevent and repel crimes of smuggling, trade fraud, counterfeit goods, and intellectual property infringement. After 2 weeks of peak implementation, functional forces, units, and localities have inspected, detected, and arrested more than 450 violations of trade, trade fraud, counterfeit goods, and tax evasion, with a total value of goods and exhibits of more than 40 billion VND.

In addition to the achieved results, the work of combating smuggling, trade fraud and counterfeit goods still has shortcomings and limitations; in which, the institutions and sanctions for handling violations are not enough to deter; the work of combating smuggling, trade fraud and counterfeit goods is still complicated, the number of violations detected and handled does not reflect reality, does not best meet the requirements of the task; there is still a situation where officials are lax in management, covering up violations; the situation of smuggling, trade fraud and counterfeit goods is increasing, especially in the e-commerce environment has not been detected and handled promptly, causing budget losses, causing anxiety and insecurity, affecting the investment, business and international integration environment of Vietnam...

In order to achieve the highest efficiency in the peak period of the fight against smuggling, trade fraud, counterfeit goods, and intellectual property infringement in accordance with the direction of the Prime Minister, ministries and branches that are members of the National Steering Committee 389, the Working Group and the People's Committees of provinces and centrally-run cities, including the People's Committee of Lang Son province, are required to focus on implementing the proposed solutions resolutely, synchronously, and effectively.

In particular, the Deputy Prime Minister requested ministries and branches to continue to thoroughly grasp and seriously implement the Prime Minister's instructions in Official Dispatch No. 65/CD-TTg dated May 15, 2025, Directive No. 13/CT-TTg dated May 17, 2025 and the instructions of the Deputy Prime Minister, Head of the National Steering Committee 389, Head of the Prime Minister's Working Group in Document No. 548/TTg-VI dated May 17, 2025 with the highest political determination; concretize the instructions into work plans; functional forces inspect, detect and strictly handle violations; if there are signs of crime, immediately transfer them to competent agencies for handling in accordance with the provisions of law; continue to implement the peak of the fight to prevent and repel smuggling, trade fraud, counterfeit goods, and goods infringing intellectual property.

Strict control of goods origin

Specifically, the Deputy Prime Minister requested the Ministry of Finance (Customs force) to strictly control imported goods, goods of unknown origin, poor quality, and smuggled goods into Vietnam.

The Ministry of Industry and Trade directs strict handling of cases of smuggling, production and trade of counterfeit goods, and infringement of intellectual property rights; reviews the Law on Commerce and E-commerce, promptly submits to competent authorities for amendments and supplements; coordinates with relevant ministries and branches to study, amend, and supplement the functions, tasks, and sanctioning authority of functional forces, in the direction of clearly defining responsibilities and areas.

The Ministry of Science and Technology urgently reviews and proposes amendments and supplements to the Law on Intellectual Property and the Law on Product and Goods Quality; strengthens inspection and strictly handles violations of publishing false information.

The Ministry of Agriculture and Environment strengthens inspection and handling of violations related to forestry products, aquatic products, plant varieties, pesticides, and fertilizers; and controls the use of growth stimulants.

The Ministry of Public Security directs the resolute fight against and strict handling of criminal acts; coordinates with prosecution agencies to speed up investigation, prosecution, and trial of cases; and clarifies the responsibilities of relevant ministries, branches, and localities for violations.

Strictly handle irresponsible officials in the fight against smuggling and trade fraud

The Deputy Prime Minister also requested ministries and branches to strengthen and closely combine the Party's inspection and supervision work with thematic inspection and examination work in each management field, avoiding overlap but clarifying responsibilities; strictly handling cadres, civil servants and officers who lack responsibility in leadership, direction, management, and violations of anti-smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights; promptly praising and rewarding positive examples and good practices.

Ministries and branches review and propose to improve mechanisms and policies related to handling violations, especially regarding the origin of goods and intellectual property rights; apply technology in the fight and supervision; actively communicate and propagate about the dangers and negative impacts of smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights to raise awareness and responsibility of officials, civil servants and the people; propagate and disseminate tricks and methods of fraud and deceit of subjects so that people know, raise vigilance and promptly inform competent authorities.

The Deputy Prime Minister requested the Provincial Party Committee Secretaries and Chairmen of the People's Committees of provinces and centrally-run cities to continue to direct agencies, units and functional forces under their authority to thoroughly grasp, deploy and strictly implement the directions of the Government and the Prime Minister on the fight against smuggling, trade fraud and counterfeit goods in the new situation.

Continue to strengthen leadership and direction of local Party committees and political systems to actively participate in the fight against smuggling, trade fraud, counterfeit goods, and intellectual property infringement; resolutely prevent and repel negative phenomena; strictly handle cadres and Party members who have degraded political ideology, ethics, and lifestyle. Closely combine the Party's inspection and supervision work, inspection work with the supervision of agencies, elected representatives, the Vietnam Fatherland Front and its member organizations, press and media agencies, and the People to promptly detect, correct, rectify, and overcome limitations and shortcomings; strictly handle cadres, civil servants, organizations, and individuals who have irresponsible, corrupt, negative behaviors, lax leadership, direction, management, and violations of the work against smuggling, trade fraud, counterfeit goods, and intellectual property infringement.

Resolutely not to let hot spots of smuggling and illegal transportation of goods form

Provinces and cities continue to mobilize and strengthen the direction of functional forces and units (especially the Border Guard, Police, Customs, and Market Management forces) to step up the peak period of fighting to prevent and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights; strengthen inspection and control of key areas, especially border gates (in which, Lang Son province has Huu Nghi, Tan Thanh, Chi Ma border gates, and small-scale trails); resolutely prevent the formation of hot spots and gathering places for smuggling and illegal transportation of goods; improve the effectiveness of coordination between functional forces; strengthen discipline and order among the forces. In particular, focusing on dairy products, pharmaceuticals, food, and functional foods; promptly and well implementing emulation and reward work; detecting and strictly handling violations and violators.

Provinces and cities direct local press agencies to develop appropriate communication programs, increase the time, and disseminate information about the negative impacts of smuggling, trade fraud and counterfeit goods, infringement of intellectual property rights, and copyright infringement to raise awareness and responsibility of officials, civil servants, and the people; disseminate and popularize fraudulent and deceptive tricks so that people can recognize and raise their vigilance; strictly manage and control to prevent false advertising; promptly commend and disseminate examples of good people and good deeds; criticize and condemn negative and irresponsible behaviors...
