Bac Giang: Closely monitor Tan Son Residential Area project of Tan Phat Investment and Construction Joint Stock Company

The People's Committee of Bac Giang province has just issued Decision No. 420/QD-UBND, dated April 22, 2025, allocating land to Tan Phat Investment and Construction Joint Stock Company to implement the Tan Son Residential Area project, Tan Son commune, Luc Ngan district.

Specifically, the People's Committee of Bac Giang province assigned an area of ​​133,658.5 m2 of land that has been permitted by the People's Committee to change the land use purpose to Tan Phat Investment and Construction Joint Stock Company to implement the Tan Son Residential Area project, Tan Son commune, Luc Ngan district (land type according to the Land allocation area statistics table (phase 1) according to the detailed construction planning map); assigned land according to the approved investment project's operation period; The location and boundaries of the land are determined according to the land cadastral maps and attached documents.

Form of land allocation includes: The State allocates land with land use fee collection for residential land area: 35,173.3m2 (excluding 6 residential land lots planned for resettlement from lot 05 to lot 10, area 648 m2) in Tan Son Residential Area, Tan Son Commune, Luc Ngan District.

The State allocates land without collecting land use fees to invest in the construction of technical infrastructure works according to the approved planning with an area of: 98,485.2 m2 (including 648 m2 of resettlement land).

Land allocation method through bidding to select investors to implement projects using land; Investors must bear restrictions on land user rights according to law.

The Provincial People's Committee assigned the People's Committee of Tan Son commune an area of ​​272.9 m2 (including annual crop land BHK 9.1 m2, traffic land DGT: 112.7 m2; rice land LUC 151.1 m2) to the People's Committee of Luc Ngan district to recover, complete compensation, support site clearance, but outside the land allocation boundary (no change of land use purpose) to manage according to planning and land law.

Location: Thac Luoi village, Khuon Phai, Cho street, Tan Son commune, Luc Ngan district.

In the Decision, the People's Committee of Bac Giang province also clearly stated the responsibilities of agencies and organizations. Specifically:

The Department of Agriculture and Environment of the province is responsible before the law for the contents of appraisal and submission to the Provincial People's Committee as mentioned above; collect fees and charges; regularly inspect and urge the use of land for the project, promptly handle violations of land and environment related to the investor (if any); determine specific land prices for the area that has changed land use purpose within the time limit and according to the provisions of law. Direct the Land Registration Office to correct, update land fluctuations and manage cadastral records according to regulations.

The Department of Finance is responsible before the law for the contents related to ensuring that the project is consistent with the provincial planning, bidding, selection of investors as the basis for changing land use purposes, allocating project land according to the provisions of Article 224 and other contents in the investment field; regularly organizing inspections and urging investors to implement approved investment projects.

The Department of Construction is responsible before the law for the contents related to construction planning, the project's conformity with the Housing Development Plan and other contents under its authority as a basis for changing land use purposes and allocating land according to the provisions of Article 224 of the Land Law; urging investors to complete the project, put it into operation and operate it in accordance with the approved investment project; strictly and promptly handling violations related to construction and operation of the project (if any).

The Tax Department of Region VI guides and urges Tan Phat Investment and Construction Joint Stock Company to fulfill its financial obligations for the area of ​​land use purpose conversion and land allocation according to the provisions of law.

Luc Ngan District People's Committee is responsible before the law for ensuring that the project is consistent with relevant local planning and plans; determining the origin and type of land, implementing land recovery, compensation, site clearance and proposing changes in land use purposes and land allocation; completing the on-site land allocation to the investor within 10 working days from the date of issuance of the Decision;

Regularly inspect and urge the use of land, project implementation and inspect and supervise the implementation of the investor's plan to use the topsoil, ensuring compliance with the provisions of the law on cultivation; promptly and strictly handle violations according to regulations (if any); urge investors to fully perform financial obligations for the M3 amount according to regulations; review and confirm the amount of compensation, support and resettlement deducted from the land use fee and send it to the tax authority to deduct the advance payment from the land use fee according to regulations; direct the People's Committee of Tan Son commune to update and correct the land records.

Tan Son Commune People's Committee adjusts land records; establishes records, strictly manages the land area allocated in Article 1, does not allow encroachment or arbitrary change of land use purpose.

Regarding Tan Phat Investment and Construction Joint Stock Company, the Provincial People's Committee requests the company to coordinate with the People's Committee of Luc Ngan district and relevant agencies to receive land handover on the field; fulfill financial obligations for the area permitted to change land use purpose, and allocate land according to legal regulations; put land into use and use land within the correct boundary and purpose assigned; comply with legal regulations on land, investment, construction, environment and related laws;

Complete the construction of the project's technical infrastructure on the assigned land area in accordance with the approved design; after completion of construction, hand over all land and infrastructure of public works, commercial services, etc. (determined in the Decision on project investment approval) to the People's Committee of Luc Ngan district for management and put into use in accordance with regulations.

At the same time, land use rights are only allowed to be transferred after all financial obligations have been fully fulfilled and conditions as prescribed by law have been met.
