On the morning of October 31, at the regular press conference of October 2025, the representative of the Ministry of Science and Technology informed about 7 decrees issued, focusing on providing detailed instructions on the contents of the Law on Science, Technology and Innovation; including Decree No. 265/2025/ND-CP detailing and guiding the implementation of a number of articles of the Law on Science, Technology and Innovation on finance and investment in science, technology and innovation (Decree 265/2025/ND-CP).

Seven financial and investment related topics

According to the representative of the Department of Planning and Finance (Ministry of Science and Technology), Decree No. 265/2025/ND-CP clearly demonstrates the spirit of the Law on Science, Technology and Innovation, which is a financial and investment policy that is regulated synchronously and consistently with legal provisions on science, technology and innovation, public investment, state budget and corporate income tax.

The innovation goal of Decree 265/2025/ND-CP is the mechanism for budget management, allocation and control associated with output efficiency assessment and accountability of state budget users, not just compliance with the input assessment process as before.

The Decree details and guides 7 contents related to finance and investment in science, technology and innovation, including: Strategy for development of science, technology and innovation; plan on science, technology and innovation; state budget for science, technology and innovation; content of state budget expenditure for science, technology and innovation; making estimates, allocating, managing, using and settling state budget for science, technology and innovation;

National Science and Technology Development Fund, National Technology Innovation Fund; Science, Technology and Innovation Development Fund of ministries, ministerial-level agencies, government agencies, other central agencies, provincial People's Committees; Science and Technology Development Fund of enterprises, organizations, public service units and enterprise expenditures for science, technology and innovation activities.

Prioritizing investment in key technology areas

An important highlight of Decree 265/2025/ND-CP is the clear and systematic provisions on the master plan for science, technology and innovation development over a 5-year period.

According to a representative of the Department of Planning and Finance, this is a regulation aimed at establishing a medium-term planning framework in the field of science, technology and innovation with strategic orientation, closely linked to the socio-economic development plan, industry and sector development plan and the national public investment plan.

This master plan is not only a resource coordination tool, but also a mechanism to ensure the connectivity between the plans of ministries, sectors and localities. It creates a foundation for unifying goals, clearly quantifying the results to be achieved and orienting investment priorities for key technology areas and leading sectors to promote sustainable economic development.

The Decree also specifies the process of developing, consulting, approving and monitoring and evaluating the 5-year science, technology and innovation plan, ensuring transparency, science and accountability of ministries, branches and localities, as a basis for adjusting the allocation of the state budget and arranging public investment capital for the next period.

It can be said that this regulation helps the State not only better manage investment resources for science, technology and innovation, but also play a leading role in the national development strategy based on knowledge and innovation.

Transparent and public budget allocation, linked with inspection

One of the new points of Decree No. 265/2025/ND-CP is the mechanism for supplementing/adjusting funding for public science and technology organizations based on the assessment of the performance of these organizations to improve the operational efficiency, transparency and accountability of public science and technology organizations; encourage public science and technology organizations to increase the mobilization of socialized resources according to the provisions of the law on state budget; public-private cooperation to carry out scientific, technological and innovation tasks between research institutes, universities and enterprises according to the provisions of the law on investment in the form of public-private partnerships.

Mechanism for providing additional funding to ensure and maintain regular operations of public science and technology organizations with an increase or decrease of 10% based on the assessment of the organization's performance.

The representative of the Department of Planning and Finance said that the allocation of additional funding based on the assessment of the performance of public science and technology organizations ensures transparency, publicity and is linked to the inspection and evaluation mechanism of competent authorities and is implemented according to the provisions of the Decree detailing and guiding the implementation of a number of articles of the Law on Science, Technology and Innovation on information, statistics, evaluation, digital transformation and general issues.

The results of the performance assessment of public science and technology organizations are updated annually by the Ministry of Science and Technology and made public on the National Information System on Science, Technology and Innovation.

The State becomes a “knowledge market creator”

A very notable new point of Decree 265/2025/ND-CP is the mechanism to expand and diversify investment resources for science, technology and innovation. If previously, most science, technology and innovation activities depended on the state budget, now the decree has created a clear legal corridor to attract resources from enterprises, organizations and public service units.

Specifically, organizations, enterprises, and public service units are encouraged to establish science and technology development funds; enterprises' expenses for science, technology, and innovation are reasonably deductible when calculating corporate income tax according to the provisions of the law on corporate income tax and Resolution No. 198/2025/QH15 of the National Assembly; they are allowed to participate in placing orders and investing in innovative startup projects, innovative startup enterprises, or public-private partnerships in science, technology, and innovation tasks.

According to the representative of the Department of Planning and Finance, with this regulation, the State is not only a "sponsor" but also becomes a "knowledge market creator", where each public capital is used to activate and lead many private capitals.

This mechanism opens up a completely new approach: mobilizing the combined strength of the entire society - from the public and private sectors, research institutes to technology startups - so that science, technology and innovation truly become the key driving force of sustainable growth.
