Discussing at the Hall on the draft Law on Supervisory Activities of the National Assembly and People's Councils (amended), many delegates proposed to continue to regulate the supervisory authority of the People's Council Delegation Group, especially in the 2-level local government model, when there is no district-level organization, there needs to be a Provincial People's Council Delegation Group as an extended arm at the grassroots level, to ensure the continuity of supervisory information from the province to the commune.

Article 37 on the supervisory authority of the People's Council Delegation, the draft Law is stipulating 2 options.

Option 1: The People's Council delegation supervises the enforcement of laws at the local level when assigned by the People's Council or the Standing Committee of the People's Council at the same level.

Option 2: Do not specify the authority of the People's Council Delegation.

I agree with Option 1. Because, in practice, the People's Council Delegation is a supervisory institution close to the people, close to the grassroots, proactive and flexible.

From the experience of being a provincial People's Council delegate, the People's Council Delegation in the locality where I work is always proactive, closely following and grasping the actual situation. Many thematic supervisions and supervisions arising from practices outside the previously issued plans have promptly discovered and recommended inadequacies in land management, public investment, ethnic policies and social security.

Thanks to the monitoring activities of the People's Council Delegation, the recommendations are conveyed more quickly, helping local authorities to promptly resolve and remove difficulties and obstacles in the process of law enforcement, creating trust among the people.

If the regulation on the supervisory authority of the People's Council Delegation Group is removed as in Option 2, it will reduce the initiative and flexibility in supervision, especially in large areas and ethnic minority areas, where the People's Council Delegation Group is often the most direct and closest channel to grasp practical situations.

At the same time, to further improve the effectiveness of the People's Council Delegation's supervision, it is recommended that the responsibilities of the People's Council Standing Committee in assigning tasks and monitoring the supervision results of the People's Council Delegation's supervision should be more clearly defined, ensuring that this activity is not just a formality but has concrete results.

Strengthening information support and coordination conditions between the People's Council Delegation Groups and the People's Council and People's Committee agencies, so that the People's Council Delegation Groups have a basis for making accurate assessments and recommendations.

The People's Council delegation reports the results of supervision to the People's Council Standing Committee and widely informs voters, except in cases where the law stipulates that it cannot be made public, ensuring transparency.

Choosing Option 1, continuing to regulate the supervisory authority of the People's Council Delegation is not only inheriting the current law but also a necessary step to consolidate and promote the role of People's Councils at all levels, especially in the context where we are promoting decentralization, increasing autonomy and self-responsibility of local governments and building local governments close to the people.

It is proposed to stipulate that the People's Council Delegation supervises the implementation of laws at the local level when assigned by the People's Council or the Standing Committee of the People's Council at the same level as in Option 1, Article 37 of the draft Law.

Because the People's Council Delegation is an important bridge between the People's Council and voters in the constituency. The People's Council Delegation, through activities of contacting voters and gathering information from the grassroots, has the most favorable conditions to carry out supervision at the grassroots level.

If we do not stipulate supervisory authority for the People's Council Delegation, we will lose a very important and effective supervisory channel at the grassroots level.

In particular, when the two-level local government comes into operation, the supervision of the People's Council Delegation Group will ensure closeness to the people and timely grasp of information and breath from the Delegation Groups where the delegates are running for election.

However, it is recommended that the drafting agency provide clearer regulations on the process of assigning supervision tasks to the People's Council Delegation Group, including funding, document provision and reporting responsibilities so that the supervision activities of the People's Council Delegation Group are formalized and quality is ensured. The supervision of the People's Council Delegation Group should focus on supervising topics right at the Delegation Group where the People's Council delegates are running for election, and supervising the resolution of voters' petitions and concerns right at the constituency.

I agree with the plan for the People's Council Delegation to supervise the implementation of laws at the local level when assigned by the People's Council or the Standing Committee of the People's Council at the same level. Because in the 2-level local government model, when there is no organization at the district level, there needs to be a People's Council Delegation Delegation at the provincial level as an extended arm at the grassroots level, to ensure the continuity of monitoring information from the province to the commune, without creating additional apparatus, but increasing efficiency, promptly detecting problems at the grassroots level to help the Provincial People's Council grasp the reality, supervise more accurately and deeply in the process of organizing supervision.

In Article 36, the draft Law has stipulated questioning at the People's Council Session, but it is still general and lacks a mandatory mechanism. Therefore, it is recommended that the Drafting Committee study and supplement the regulation that the person being questioned must directly answer, authorization can only be done in cases of force majeure and must bear joint responsibility. The questioning session is recorded, broadcast live, and the full text is made public on the People's Council Information Portal to increase publicity, binding and enhance the responsibility of the head, while ensuring the principle of transparency.
