Mandatory traceability of high-risk products

For high-risk products, traceability is mandatory, determined by the sector and industry management department and has a roadmap for implementation, ensuring feasibility, suitability with the capacity of the enterprise and the development characteristics of each industry.

At the end of the morning session of the National Assembly Standing Committee (NASC) on June 3, the Committee listened to Chairman of the Science, Technology and Environment Committee Le Quang Huy present a report on a number of major issues in explaining, accepting and revising the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality.

Receiving the opinions of National Assembly deputies, Mr. Le Quang Huy said that the draft law has added regulations on classifying products and goods based on the level of risk, specifically including 3 types: low-risk products; medium-risk products; high-risk products. The criteria for classifying and controlling risks include: the ability to cause harm or be unsafe; the ability to detect risks when circulating or using; the popularity and nature of use of the product; the level of damage if the risk occurs.

Based on the classification of product groups, the state management agency for product quality will apply corresponding management measures such as exemption, reduction of inspection or application of post-clearance inspection (post-inspection); pre-clearance inspection (pre-inspection); reduction of inspection according to other provisions of law.

The draft law stipulates that the Government shall prescribe criteria for risk assessment, basis for classifying products; promulgate a list of products with average and high risk levels and requirements for quality management of corresponding products; stipulate the responsibilities of ministries, branches and provincial People's Committees in inspecting the development and promulgation of lists of products with average and high risk levels.

Regulations on national quality infrastructure, including the establishment of a national SPHH quality monitoring system based on data, have also been included in the draft law.

“Such regulations are appropriate, ensuring both the role of the presiding agency and the initiative of ministries managing sectors and fields, contributing to improving management efficiency, focusing resources to control high-risk goods and reducing compliance costs for businesses,” said Chairman Le Quang Huy.

Regarding traceability and transparency of the supply chain of products, the draft law has added a provision that for products with high risk levels, traceability is mandatory, determined by the industry and sector management ministry and has a roadmap for implementation, ensuring feasibility, suitability with the capacity of enterprises and the development characteristics of each industry.

The remaining products (goods with medium and low risk levels) are not required to apply. The traceability and transparency of the supply chain of products must be implemented on the principle of ensuring no obstruction to the circulation of goods and consistent with the provisions of the law on customs, trade, tax and trade defense.

Regarding the responsibility of the owner of the digital platform serving electronic transactions in managing the quality of products and services, the draft law adds a provision that the owner of the digital platform serving electronic transactions is responsible for complying with the provisions of the law on electronic transactions, e-commerce and other relevant legal provisions; taking measures to inspect and handle goods that violate the law on quality when detected or when requested by a competent state management agency; ensuring consistency with the provisions of the Law on Protection of Consumer Rights, the Law on Electronic Transactions and the law on electronic transactions.
