On November 13, the National Assembly discussed in the hall the draft Law on Civil Servants (amended) . Minister of Home Affairs Do Thanh Binh explained and clarified a number of issues of concern to delegates.
The Minister said that some delegates suggested considering not regulating the organization and operation of public service units in Article 5 of the draft law, but rather leaving it to the law on organization and operation of public service units.
However, during the time the law on organization and operation of public service units has not been promulgated, it is proposed that the National Assembly keep the provisions in the draft law as a basis for sub-law documents to be promulgated and maintain stability in the operation of public service units.
Many delegates are concerned about innovation in the management and use of civil servants, taking job positions as the center for recruiting, using, evaluating, and classifying the quality of civil servants, implementing regimes and policies on salaries, bonuses, and other regimes and policies related to the civil servant team.
In response to comments, the Ministry of Home Affairs will review the provisions on recruitment grounds; recruitment principles; recruitment methods and regulations on job positions in the draft law.
Regarding the authority to recruit civil servants, at this session, the Government also submitted to the National Assembly a draft Resolution of the National Assembly on a number of specific and outstanding mechanisms and policies to make breakthroughs in education and training development.
This includes regulations on recruitment authority for civil servants who are teachers in public educational institutions; at the same time, it stipulates that in case there is a difference in the same content between this Resolution and the law, the provisions of this Resolution shall apply.
Therefore, the specific regulations for teachers will be implemented according to the provisions of this Resolution. For other contents, the Ministry of Home Affairs will coordinate with relevant agencies to review and ensure consistency between the draft law and the provisions of the laws on specialized civil servant management.

Another content is allowing civil servants to sign labor contracts or service contracts to perform professional activities with agencies and organizations other than the public service unit where they are working.
According to the Minister, the delegates' opinions are in high agreement with the policy of allowing civil servants to sign labor contracts and work contracts to create a mechanism for connecting human resources between the public and private sectors; at the same time, creating conditions for civil servants to increase their legitimate income from their labor.
In response to comments, the Ministry of Home Affairs will review and adjust to ensure the principle of creating maximum conditions for civil servants in their professional activities, but at the same time must ensure transparency, avoiding conflicts of interest and policy exploitation.
Regarding the evaluation and classification of civil servants, many delegates expressed their concern about the evaluation method, ensuring that the evaluation must be substantial based on the principle of being linked to products and results of task performance; quantitative, objective, and multidimensional.
The Ministry of Home Affairs will review and revise to prescribe principles and authorities for regular, continuous, and multi-dimensional assessment based on results, quality of public service and people's satisfaction; apply digital technology, build a national database on civil servants to ensure publicity and transparency in assessment, management and development of civil servants.
