On March 31, 2025, the Ministry of Interior issued Official Letter No. 776 in response to Official Letter No. 1498 dated February 26, 2025, from the People's Committee of Quang Nam province regarding the request to recognize Mr. Tran Van Quy as a martyr.
In the official document, the Ministry of Interior stated that the application for recognition of Mr. Tran Van Quy as a martyr was prepared by the People's Committee of Quang Nam province in accordance with the provisions of point g, clause 1 of Ordinance No. 26 (dated June 29, 2005) of the Standing Committee of the National Assembly.
Based on the guiding documents at the time Ordinance No. 26/2005 came into effect, the determination of the list of areas with particularly difficult socio-economic conditions for consideration and recognition of martyrs is regulated by Joint Circular No. 07 (dated May 4, 2007) of the Ministries of Labour, Invalids and Social Affairs , National Defense, and Interior.
"Based on the above regulations, Dai Son commune, Dai Loc district, is not included in the list of areas under consideration. The Quang Nam Provincial People's Committee's determination of the list of economically and socially disadvantaged areas according to Decision No. 113 (dated July 20, 2007) of the Prime Minister for application in considering the recognition of martyrs is unfounded," - Ministry of Interior's Official Letter 776 stated.
According to the Ministry of Interior, Dai Son commune is currently not included in the list of border areas, coastal areas, and islands with particularly difficult conditions for consideration of martyr status under point h, clause 1, Article 14 of the Ordinance on Preferential Treatment for People with Meritorious Contributions to the Revolution No. 02 (dated December 9, 2020) of the Standing Committee of the National Assembly (issued in Appendix IV of Government Decree No. 131 dated December 30, 2021). Therefore, there is no basis for the Ministry of Interior to consider submitting a proposal to the Prime Minister to recognize Mr. Tran Van Quy as a martyr, as requested by the People's Committee of Quang Nam province.
According to the Certificate of Sacrifice issued by the People's Committee of Quang Nam province on November 14, 2024, Mr. Tran Van Quy (born in 1987, from Tam Phu commune, Tam Ky city, Quang Nam province), an employee of Mobile Forest Protection and Fire Prevention Team No. 2 - Quang Nam Forest Protection Department, sacrificed his life on May 15, 2011, on the Vu Gia River, Giang Xay waterfall (Mo O), Dai Son commune, Dai Loc district, Quang Nam province.
Mr. Quy sacrificed his life while implementing the plan for forest management and protection in the second quarter of 2011 and the plan for inspecting and controlling forest products of Mobile Forest Ranger and Forest Fire Prevention Team No. 2 under the Quang Nam Forest Protection Department.
After Mr. Quy's death, Mr. Tran Duc Dung (Mr. Quy's father) requested the competent authorities to prepare a dossier to submit to the Prime Minister for recognition of his son as a martyr. The Quang Nam Provincial People's Committee repeatedly sent documents requesting opinions and proposing the recognition of Mr. Quy as a martyr, but the Ministry of Labor, Invalids and Social Affairs replied that he "did not meet the criteria".
Due to repeated requests and requests that went unanswered, Mr. Dung filed a lawsuit. On August 19, 2024, the High Court in Da Nang ruled in favor of Mr. Dung, compelling the Quang Nam Provincial People's Committee to carry out the procedures to request the Ministry of Labor, Invalids and Social Affairs to submit a proposal to the Prime Minister to recognize Mr. Tran Van Quy as a martyr.
