On the afternoon of November 17, the National Assembly discussed in the hall the draft law amending and supplementing a number of articles of 10 laws related to security and order. One of the laws proposed to be amended is the Law on Road Traffic Order and Safety.
According to the draft, passenger cars with 8 seats or more (not including the driver's seat) used for transportation business must install journey monitoring devices, devices to record images of the driver and images of the passenger compartment.

Impact on human rights?
Delegate Pham Van Hoa (Dong Thap delegation) requested an impact assessment when proposing regulations on installing image recording devices in passenger compartments. This will affect people's personal rights.
"We must evaluate objectively, survey reality, and get opinions on the impact. Why do we have this regulation? What are the shortcomings that make it so?", Mr. Hoa questioned.
Also concerned, delegate Chu Thi Hong Thai (Lang Son delegation) cited the practice in many countries around the world , passenger images are classified as sensitive personal data. They have very strict regulations on the scope, purpose of use, storage time limit, and at the same time require all access to be logged to ensure control.
According to delegate Thai, the draft law has provisions on the system of collecting, storing, and transferring data from journey monitoring devices and image recording devices on vehicles; regulations on the purpose of using data as well as the construction, management, ensuring information security and safety, and protecting personal data...
However, Ms. Thai said there are still gaps related to the principles of using images in the passenger cabin, which is a type of sensitive data directly related to passenger privacy.
The draft does not clearly define the subjects who are entitled to access data, access conditions, access control mechanisms, nor the requirement to prohibit the use or sharing of data outside the scope permitted by law.
This gap can lead to abuse, misuse or illegal sharing of image data, affecting the legitimate rights and interests of citizens.
The delegate proposed to supplement the direction that the collection, recording, storage, exploitation, use and sharing of data, including images of passenger compartments, must be carried out for the right purpose of serving the work of ensuring traffic order and safety and handling violations, with the right authority, controlled and accessed, and must not be used to provide data outside the permitted scope...

Explaining the above content, General Luong Tam Quang, Minister of Public Security, said that the regulations related to the installation of image recording devices on passenger transport vehicles have the "ultimate goal" of ensuring passenger safety. All data will be protected according to the law, and anyone who violates will be handled.
The Minister of Public Security commented that the draft stipulates the installation of image recording devices in the passenger compartment, which is the public compartment, not the private compartment, "but we do not raise the issue of private compartments or vehicles not operating for public purposes."
The purpose of the installation requirement is to prevent all activities that violate the law, national security, order and social safety.
Receiving the opinions of the delegates, Minister Luong Tam Quang said that the drafting agency will carefully study and assess the impact.
Regarding the journey monitoring device, the Minister of Public Security said that in the world today, all manufactured vehicles have this device. Journey monitoring cameras will contribute to ensuring that all vehicles participating in traffic must comply with traffic laws.
