In the Circular, the Ministry of Health guides the authority to prepare budget estimates for implementing the support policy prescribed in Point b, Clause 2, Article 10 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH dated April 15, 2016 of the Minister of Health, the Minister of Finance , and the Minister of Labor, War Invalids and Social Affairs detailing Decree No. 39/2015/ND-CP dated April 27, 2015 of the Government stipulating support policies for women from poor households who are ethnic minorities when giving birth in accordance with the population policy, which was amended and supplemented in 2018, and implemented by the People's Committees at the commune level.
Regarding the authority to synthesize the state budget estimates for implementing support policies established by the commune level, it is stipulated in Clause 2, Article 8 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH, amended and supplemented in 2018, implemented by the Provincial People's Committee.
In the Circular, the Ministry of Health stipulates the authority to allocate funds to implement support policies for commune level as prescribed in Point c, Clause 2, Article 10 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH, amended and supplemented in 2018, implemented by the Provincial People's Committee.
Regarding the receipt of reports on the implementation of support policies for poor ethnic minority women when giving birth in accordance with population policies , the Ministry of Health clearly states the authority to receive reports on the implementation of support policies prescribed in Point b, Clause 2, Article 9 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH, amended and supplemented in 2018, by specialized health agencies under the People's Committees at the provincial level.
Regarding the procedure for receiving reports, the Ministry of Health stated that before October 15 every year, the People's Committee at the commune level shall prepare a report and send it to the specialized health agency under the People's Committee at the provincial level.
Regarding the encouragement to maintain a stable replacement fertility rate for the collective, the Ministry of Health clearly stated the authority to reward the cases specified in Section 2, Point a, Clause 1, Article 3 of Circular No. 01/2021/TT-BYT dated January 25, 2021 of the Minister of Health guiding a number of contents for localities to promulgate reward and support policies for collectives and individuals who perform well in population work carried out by the People's Committees at the commune level.
The authority to reward cases specified in Section 3, Section 4, Point a, Clause 1, Section 1, Point a, Clause 2, Article 3 of Circular No. 01/2021/TT-BYT is implemented by the Provincial People's Committee.
Regarding the encouragement to control the gender imbalance at birth for the collective , the Ministry of Health clearly stated the authority to reward the cases specified in Clause 1, Article 4 of Circular No. 01/2021/TT-BYT implemented by the Provincial People's Committee.
Regarding incentives for contributing to improving population quality , the Ministry of Health stipulates the authority to reward the cases specified in Section 1, Point a, Clause 2, Article 5 of Circular No. 01/2021/TT-BYT implemented by the Provincial People's Committee.
The Circular of the Ministry of Health clearly states the authority to receive specialized population statistical reports at the commune level as prescribed in Point d, Clause 1, Article 4 of Circular No. 01/2022/TT-BYT dated January 10, 2022 of the Minister of Health regulating the initial recording and reporting regime of specialized population statistical reports by specialized health agencies under the People's Committees of the provincial level.
The authority to receive specialized population statistical reports of medical facilities providing population services in the commune as prescribed in Section 1, Point d, Clause 2, Article 4 of Circular No. 01/2022/TT-BYT is implemented by the People's Committee at the commune level.
The authority to receive specialized population statistical reports of the focal unit performing population work at the commune level specified in Point a, Clause 1, Article 4 and medical facilities (including non-public medical facilities) providing population services specified in Section 2, Point d, Clause 2, Article 4 of Circular No. 01/2022/TT-BYT in the province is implemented by the specialized health agency under the Provincial People's Committee.
This Circular takes effect from July 1, 2025 and expires from March 1, 2027.
Circular No. 10/2011/TT-BYT dated February 25, 2011 of the Minister of Health guiding the staffing of the Center for Population - Family Planning of districts, towns, and provincial cities ceases to be effective from the effective date of this Circular.
During the effective period of this Circular, if the provisions on authority and responsibility for state management in this Circular are different from the Circulars issued by the Minister of Health before July 1, 2025, the provisions in this Circular shall apply.
