In reality, thousands of disputes and lawsuits that occur each year originate from a lack of legal knowledge, subjectivity when signing contracts or trusting verbal promises. Some people think they are just "borrowing money as collateral", but sign a sales contract; some people hand over their houses and red books without knowing they have lost ownership. These seemingly isolated stories are happening every day, leaving serious consequences both economically and mentally.
“Analysis of pitfalls in buying and selling houses and land” by a group of authors including: Land management engineer - Real estate legal expert Nguyen Tuan, MSc. Nguyen Truong Giang, MSc. Nguyen Thi Ngoc Anh - was born from those realities, with the goal of helping people understand potential risks, master legal regulations and know how to protect themselves.
The book consists of two main parts: the first part focuses on explaining important legal concepts such as sham contracts, bona fide third parties, deposit contracts, full authorization contracts, red books - pink books; the second part analyzes in depth real-life situations, providing lessons and solutions to avoid them. Each example is presented vividly, easy to understand, and linked to a real story, helping readers easily visualize and draw lessons for themselves.
One of the most dangerous traps mentioned in the book is the form of “fake contract”. This is a sophisticated trick when the lender asks the borrower to sign a real estate sale contract as a “guarantee”, in fact, to hide the loan. When the borrower is unable to repay the debt, this contract is presented as a legal sale transaction and the borrower loses the property. If there is no evidence to prove this is a fake transaction, the court will recognize the sale contract, and the people are completely at a disadvantage.

Another type of trap is “full power of attorney”. This is a seemingly convenient form but contains unpredictable risks. When signing a full power of attorney, the authorized person has the right to dispose of the property on behalf of the owner, including selling, transferring, and mortgaging. Just one mistake or misplaced trust can cause the property to be legally resold to a bona fide third party, leaving the owner with no right to reclaim it. The book also points out new scams such as “buying a house with a bank mortgage”, “quick transfer” or “authorization with conditions”, all of which are presented with specific handling instructions.
According to Land Management Engineer - Real Estate Legal Expert Nguyen Tuan, who has worked in the Environmental Resources industry for more than 13 years and "practical combat" in the real estate sector for 15 years, the key point that makes people easily fall into traps is the lack of legal knowledge and subjective mentality: "I once witnessed a case where the borrower was forced to sign a fake 'house sale and purchase' contract to make a promise, then lost the property - one of the typical situations we included in the book to warn readers. I also fell into a similar situation.
When I was young, I thought that understanding the profession was enough, but it was my subjectivity and emotional trust that almost caused me to lose everything in a land deal. Since then, I realized: in this market, anyone can be a victim if they lack legal knowledge and are not alert to seemingly reasonable tricks.
What I have learned after more than 15 years of working in this field is: real estate is not just an asset, but a test of alertness, understanding and ethics. Therefore, when working with co-authors to write the book 'Analysis of pitfalls in buying and selling houses and land', we wanted to do something very practical: help people see the real risks, and from there know how to protect themselves.
In addition to pointing out common tricks, the book also provides the latest legal system related to land, housing, loans, mortgages and transfers. In particular, the last part of the book summarizes six steps to avoid risks when trading real estate: collect evidence, do not sign fake contracts, do not hand over original documents, monitor changes in the red book, act promptly when detecting signs of fraud and always consult a lawyer before signing.
