Giving opinions on handling land lease for mineral exploitation projects

(Baoquangngai.vn) - On the afternoon of March 28, Chairman of the Provincial People's Committee Dang Van Minh chaired a meeting with relevant departments and branches to listen to reports on difficulties and give policies on handling mineral exploitation projects that have been licensed for exploitation since 2022 but do not have contracts or land lease contract appendices. Attending the meeting were Vice Chairmen of the Provincial People's Committee: Tran Hoang Tuan, Tran Phuoc Hien, and representatives of relevant departments and branches.

According to the report of the Department of Natural Resources and Environment, currently, mineral exploitation projects for common construction materials are facing many difficulties due to legal regulations. At Point d, Clause 3, Article 62 of the Land Law and documents guiding the implementation of the Land Law of the Ministry of Natural Resources and Environment stipulate that in case of using land to implement projects for mineral exploitation for common construction materials, the investor and the land user shall agree through the form of receiving transfer, lease, or receiving capital contribution in the form of land use rights to implement the project.

The State does not issue a decision to reclaim land. In case the land area for project implementation includes a part of the land area allocated by the State for management, agricultural land used for public purposes, the State shall reclaim the land, organize an auction of land use rights to allocate land, lease land, or lease land without auctioning land use rights. Based on the above regulations, when implementing mineral exploitation projects for common construction materials in the province, there are many difficulties, especially now that the province is preparing to grant a series of land mines to contractors for the construction of the North-South Expressway, the section passing through Quang Ngai.

After listening to the comments of specialized departments and branches, especially the analysis from the practice in the process of applying the above regulations, Chairman of the Provincial People's Committee Dang Van Minh said that in the coming time, the province will have some changes in the implementation of land allocation and land lease for mineral exploitation projects. The province will consider issuing a notice of land recovery for areas with land mine planning, to facilitate the settlement of subsequent procedures, put the mine into operation soon, and ensure enough construction materials for works and projects in the area.
