National Assembly Chairman: Strictly implement legislative process, fight against group interests

This morning, the National Assembly Standing Committee organized the first law-making forum with the theme "Improving institutions and laws to meet the requirements of national development in the new era".

In his opening speech, National Assembly Chairman Tran Thanh Man emphasized that law-making is a central, continuous, and regular task of the National Assembly.

Unprecedented legislative initiatives

According to the National Assembly Chairman, for the first time, the law-making forum was held together with the summary of the work of the 15th National Assembly. This is an opportunity to objectively and comprehensively assess the legislative work of the National Assembly, thereby proposing solutions to continue perfecting institutions and laws.

Assessing the work of law-making, he said that during the 15th National Assembly's term, there were many innovations, promoting the role of "being one step ahead in terms of institutions", affirming the central position of the National Assembly in perfecting institutions.

The National Assembly amended and supplemented the 2013 Constitution with 100% of the delegates present voting in favor. This is vivid evidence of the National Assembly's timely institutionalization of the Party's correct policy on reorganizing the state apparatus.

The National Assembly has reviewed and passed a large number of laws and resolutions, with many historic decisions, promptly removing difficulties and obstacles, promoting socio-economic development, ensuring national defense, security, foreign affairs, and preventing corruption, waste, and negativity.

In particular, at the last four sessions of the term, the National Assembly clearly demonstrated the spirit of innovation in law-making thinking; application of science, technology, and artificial intelligence. The laws only regulate issues under the authority of the National Assembly, giving the Government proactive and flexible authority in organizing law implementation; promoting administrative procedure reform, decentralization, and delegation of power.

At the 8th session, the National Assembly passed 18 laws; at the 9th session, the National Assembly amended the Constitution and passed 34 laws, and it is expected that the 10th session will pass 49 laws.

Mr. Tran Thanh Man stated that the National Assembly has been flexible and responded promptly to new situations, deciding on difficult and complicated issues arising from practical life such as mechanisms and policies to prevent and control the Covid-19 pandemic, allowing the Government to issue resolutions to adjust other provisions of the law in some special cases...

"These are unprecedented legislative initiatives, demonstrating the spirit of the National Assembly always accompanying the Government and the political system," the National Assembly Chairman shared.

From "pre-check" and "absolute safety" thinking to proactively accepting controlled risks

However, the National Assembly Chairman also acknowledged that there are still some difficulties and limitations in legislative work, such as the completion of institutions that have not fully met practical requirements. Regulations in some laws have not really adapted quickly to the context of international integration; some legal regulations are still lacking in synchronization, feasibility, and predictability.

The National Assembly Chairman affirmed that the law-making work must be closely coordinated from both sides. If the submitting agency prepares early, remotely, and carefully prepares documents for the review agency, the Ethnic Council and the committees, to present to the Standing Committee, and then to the National Assembly, the quality of the law will be improved.

"We already have the law, but it requires the issuance of a decree soon. Once the decree is in place, a circular must be issued. Once the law, decree, and circular are in place, it is very necessary to thoroughly understand and study it among officials and people, so that every official and every person lives and works according to the Constitution and the law. This is the most important issue that we must continue to implement in the coming time...", the National Assembly Chairman stated.

The National Assembly Chairman hopes that the forum will propose solutions to overcome difficulties and limitations in law-making work.

In it, he suggested the effective implementation of Resolution No. 66 of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era; strictly implementing the legislative process, resolutely preventing and combating negativity and group interests.

In addition, he proposed continuing to implement the requirement of innovative thinking in law-making, making the legal system a competitive advantage and a driving force for national development, identifying law-making as "a breakthrough of breakthroughs".

Presenting the introductory report, Chairman of the Law and Justice Committee Hoang Thanh Tung said that legislation needs to shift from the mindset of "pre-inspection" and "absolute safety" to proactively accepting controlled risks, expanding space for innovation.

Key new issues such as data and digital assets, artificial intelligence, carbon markets, and innovation need to be legislated.

In the synchronous and effective operation of the two-level local government model, he affirmed that decentralization and delegation of power need to be further promoted, but effective post-inspection and monitoring mechanisms must be designed.

The new era opens up many development opportunities but also creates many challenges. Legislative work will continue to be focused on to ensure and effectively protect privacy rights in the online environment, the right to access digital services, the right to protect personal data...

Mr. Tung also noted that the work of law-making needs to be further reviewed to improve and ensure transparency in all stages of the process of drafting and promulgating documents, avoiding loopholes, negativity and the mechanism of asking and giving; strengthening supervision and inspection of law enforcement and improving the effectiveness of recovering corrupt assets, ensuring real deterrence.
