(MPI) - On October 11, 2024, the Minister of Planning and Investment issued Decision No. 2373/QD-BKHĐT promulgating newly issued administrative procedures in the field of supporting cooperative groups, cooperatives, and cooperative unions under the management scope of the Ministry.

Accordingly, the new administrative procedure at the commune level is to Register the support needs of cooperative groups, cooperatives, and cooperative unions based on the legal basis of the 2023 Law on Cooperatives; Decree No. 113/2024/ND-CP dated September 12, 2024 of the Government detailing a number of articles of the Law on Cooperatives, implemented by the People's Committee at the commune level directly or through the public postal service or through the electronic environment.
The specific contents of this newly issued administrative procedure include: Implementation sequence; Implementation method; Document components; Number of documents; Processing time; Implementing agency; Subjects performing administrative procedures; Results of administrative procedure implementation; Fees; Name of application form, declaration form; Requirements and conditions for performing procedures; Legal basis of administrative procedures.
Cooperative groups, cooperatives, and cooperative unions shall submit 01 set of Application for support needs to the People's Committee of the commune where the cooperative group has its transaction address, or where the cooperative or cooperative union has its head office. The application shall be submitted to the People's Committee of the commune by one of the following methods: directly; or via public postal service; or online via the National Information System on Cooperatives/National Public Service Portal.
The application for support needs includes: Application for support needs, including a commitment not to violate prohibited acts as prescribed in Clause 2, Article 7 of the Law on Cooperatives 2023, not to be serving a criminal sentence of the Court that has come into legal effect according to Form No. 01 in the Appendix issued with Decree No. 113/2024/ND-CP dated September 12, 2024 of the Government detailing a number of articles of the Law on Cooperatives; Copies of relevant documents and records demonstrating compliance with the prescribed beneficiary criteria.
Cooperative groups, cooperatives, and cooperative unions are responsible before the law for the accuracy and truthfulness of the information provided in the above-mentioned registration dossier for support needs. The processing time is 10 working days from the date of receipt of valid dossiers. No later than 10 days from the date of receipt of dossiers, the People's Committee at the commune level shall notify the cooperative groups, cooperatives, and cooperative unions of the receipt of dossiers according to Form No. 02 in the Appendix issued with Decree No. 113/2024/ND-CP dated September 12, 2024 of the Government detailing a number of articles of the Law on Cooperatives.
Cooperatives and cooperative unions are considered to enjoy the policy when they are not in the period of executing decisions on handling administrative violations due to violations of prohibited acts prescribed in Clause 2, Article 7 of the Law on Cooperatives 2023; and not in the period of serving a criminal sentence of the Court that has come into legal effect.
Meet one of the following criteria at the time of submitting the application for support: the number of members increases in 02 consecutive years immediately preceding the year of submitting the application for support; the ratio of internal transaction value increases in the previous year immediately preceding the year of submitting the application for support; the ratio of undivided common fund allocation is higher than the minimum level prescribed in Article 84 of the Law on Cooperatives 2023 in the previous year immediately preceding the year of submitting the application for support; the value of undivided common assets increases in the previous year immediately preceding the year of submitting the application for support; At least 5% of the total number of members and employees have participated in education, training, dissemination, training, and coaching classes organized by the cooperative or cooperative union itself or by other agencies, unions, and organizations and have been granted a certificate of participation in the course or have a list of members and employees participating in the course stamped by the cooperative or cooperative union as of the year preceding the year of submission of the application for support; have been established for no more than 36 months in a difficult socio -economic area or an especially difficult socio-economic area according to the provisions of the law on investment as of the time of submission of the application for support. In case a cooperative or cooperative union registers to receive support from the state budget with a value of VND 3 billion or more, it must have a financial report for the previous year audited by an independent auditing organization at the time of submission of the application for support.
A cooperative group is considered to enjoy the policy when it has a Certificate of registration of a cooperative group; Not being under the enforcement of a decision to handle administrative violations due to violations of prohibited acts specified in Clause 2, Article 7 of the Law on Cooperatives 2023; Meeting one of the following criteria at the time of submitting an application for support: the number of members increases in 02 consecutive years immediately preceding the year of submitting the application for support; At least 5% of the total number of members and employees have participated in education, training, dissemination, training, and coaching classes organized by the cooperative itself or by other agencies, unions, and organizations and have been granted a certificate of participation in the course or have a list of members and employees participating in the course confirmed by the cooperative (for courses organized by the cooperative itself, the cooperative must have a plan to organize the course, course content, and a list of courses signed by course participants) as of the year preceding the year of submission of the application for support; have been established for no more than 36 months in a difficult socio-economic area or an especially difficult socio-economic area according to the provisions of the law on investment as of the time of submission of the application for support.
This Decision comes into force from November 1, 2024./.
