Ensuring facilities and materials for agencies when implementing the 2-level local government model

On June 22, Prime Minister Pham Minh Chinh issued Official Dispatch No. 95/CD-TTg on ensuring facilities and material resources for State agencies, organizations and units when implementing the arrangement, streamlining of apparatus, and rearrangement of administrative units to build a 2-level local government model.

Recently, the arrangement, streamlining of the apparatus, and arrangement of administrative units to build a 2-level local government model have been key and urgent tasks to improve the effectiveness and efficiency of the political system. To carry out this task, the Politburo and the Secretariat headed by General Secretary To Lam have made many conclusions and directions related to the issue of arrangement, placement, and handling of headquarters and facilities when arranging administrative units and building a 2-level local government model; on that basis, the National Assembly, the Government, and the Prime Minister have issued many legal documents regulating standards and norms for the use of public assets, decentralization, and delegation of authority in the management and use of public assets, arrangement, placement, and handling of working headquarters and public assets.

The Prime Minister and the Ministry of Finance have issued many documents directing and guiding the implementation, creating a political and legal basis for ministries, central agencies and localities to deploy the arrangement and reorganization of headquarters and public assets to meet work needs according to the new organizational model and handle surplus headquarters and public assets when rearranging the apparatus.

However, through monitoring the reality in localities, there have been some difficulties and problems in purchasing assets, equipment, repairing and renovating offices, official residences, as well as in the decentralization mechanism, funding sources, etc., which can delay and disrupt work, affecting the organization and operation of agencies and units when they officially come into operation under the new organizational model.

In order to promptly resolve the above difficulties and obstacles, ensure the arrangement and reorganization of headquarters and public assets to meet work needs, and avoid interruption when officially operating under the new local government organization model after the arrangement, the Prime Minister requests:

Chairmen of People's Committees of provinces and centrally run cities: Effectively implement the Ministry of Finance's guidelines on principles for handling state finances and budgets when reorganizing administrative units at all levels and building a two-level local government organization model; prevent waste, negativity, and corruption in implementation.

Quickly, drastically and promptly deploy tasks and requirements on digital transformation and information technology, including information technology data infrastructure and digital transformation to serve the arrangement of the apparatus according to the requirements and progress in Plan No. 02-KH/BCĐTW dated June 19, 2025 of the Central Steering Committee on science, technology development, innovation and digital transformation.

Arrange and allocate public property headquarters within the scope of management, ensuring facilities (headquarters, cars, machinery, equipment, IT data infrastructure, digital transformation, etc.) for the apparatus according to the new model and the activities of cadres, civil servants, public employees, and workers are carried out normally, without interruption, without affecting the provision of public services, and the settlement of administrative procedures for people and businesses when officially put into operation. Develop a plan and organize the implementation of handling surplus public property headquarters and assets in accordance with the provisions of law, the direction of the Prime Minister, the guidance of the Ministry of Finance and relevant ministries and agencies.

Directing the additional procurement according to prescribed standards and norms in cases where existing cars, machinery, equipment and other assets after being arranged, organized and harmonized do not meet the requirements for performing tasks; in cases where they are on the list of centralized procurement, the provisions of Clause 4, Article 74 of Decree No. 151/2017/ND-CP shall be applied to ensure savings, efficiency, suitability with actual usage needs and compliance with the correct order, procedures and legal regulations (in special cases, there are Resolutions and regulations of the Government, regulations on the authority of the Minister and Chairman of the Provincial People's Committee for timely consideration and decision).

Direct the consideration and decision on the application of the form of contractor selection in special cases (as stipulated in Point p, Clause 3, Article 82 of Decree No. 24/2024/ND-CP, amended and supplemented by a number of articles in Decree No. 17/2025/ND-CP) to repair and renovate working offices and official residences for provincial and communal officials and civil servants in cases where there is an urgent requirement on progress to ensure that the activities of agencies and units are carried out normally, without interruption when officially put into operation under the new organizational model, without affecting the provision of public services and the settlement of administrative procedures. The repair and renovation must ensure savings, efficiency, and compliance with the correct order, procedures, and legal regulations.

Proactively arrange local budget sources and other legal financial sources to arrange and implement the restructuring of the commune-level apparatus; for the restructuring of provincial-level agencies, the province that decides to locate the new administrative center after the restructuring is responsible for arranging funds for implementation. In case of difficulties in funding sources, the Provincial People's Committee shall promptly report to the Ministry of Finance for synthesis and submission to competent authorities for consideration and handling on June 23, 2025.

Resolutely, promptly and fully perform tasks within its authority to ensure the smooth operation of the new government apparatus; in case of difficulties or problems beyond its authority, report in writing to the Ministry of Finance for guidance. For matters within the authority of the Government and the Prime Minister, the Ministry of Finance shall synthesize and report to the Government and the Prime Minister for consideration and decision before June 25, 2025.

Ministries, ministerial-level agencies, and government agencies proactively grasp, guide, and promptly handle difficulties and problems of localities in the sectors and fields assigned to them.

The Ministry of Finance shall preside over and coordinate with relevant agencies to unify solutions, promptly remove obstacles, ensure progress; provide advance funding and synthesize funding needs of localities to submit to competent authorities for consideration and decision.

The Prime Minister assigned Deputy Prime Minister Ho Duc Phoc to directly handle the problem immediately under the Prime Minister's authority; there must be no congestion or delay.

The Government Office, according to its assigned functions and tasks, shall monitor and urge the implementation of this Official Dispatch; closely coordinate with the Ministry of Finance to handle or report to competent authorities on issues beyond its authority.
