Regarding the Draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution, delegate Pham Duc An, Chairman of the Provincial People's Committee, National Assembly delegate of Quang Ninh province, said that in Clause 1, Article 84 of the Constitution, the provision should be retained: The Central agency of the Vietnam Fatherland Front member organization has the right to submit draft laws to the National Assembly and draft ordinances to the National Assembly Standing Committee. The delegate said that the connotation of the term Central agency of the Vietnam Fatherland Front member organization will be broader than the standing body located within the Vietnam Fatherland Front agency. Thereby, ensuring the rights of the 4 major agencies of the Vietnam Fatherland Front.
Article 110 of the draft amendment to the Constitution stipulates: The administrative units of the Socialist Republic of Vietnam include provinces, centrally run cities and administrative units below provinces and centrally run cities. Clause 2, Article 111 further stipulates that special administrative- economic units are established by the National Assembly, but does not say at what level these administrative units are. Therefore, this provision needs to be clarified.
In addition, Article 111 also states that "Local government, including People's Councils and People's Committees, is organized in administrative units suitable to the characteristics of rural areas, urban areas, islands, and special administrative-economic units as prescribed by the National Assembly ". According to the delegate, there are special units, for example, islands are special zones or administrative-economic units, so it is not necessary to have both units. The delegate proposed that, for example, the establishment of the Van Don special zone mechanism, only organize administrative units. Accordingly, it should be stipulated that "The National Assembly shall specify the organization of local government in administrative units suitable to the characteristics of rural areas, urban areas, islands, and special administrative-economic units", so that the National Assembly will decide on specific issues later.
Regarding the Law on Organization of Local Government (amended), delegates proposed to study the expansion of the special economic zones that can be located on borders and islands, because of their very special nature. As for the Law on Cadres and Civil Servants, Clause 2, Article 1 stipulates the application of regulations to cadres and civil servants in special economic administrative units decided by the National Assembly. This should be precisely stipulated to only stipulate specific policies.

The delegate also requested the National Assembly and the drafting agency to study the removal of the right to submit laws of Trade Unions, Farmers' Associations, Ho Chi Minh Communist Youth Unions, Women's Unions, and Veterans' Associations when they become socio-political organizations under the Vietnam Fatherland Front.
Also contributing to this content, Delegate Tran Thi Kim Nhung, Standing Member of the National Assembly's Committee on Law and Justice, National Assembly Delegate of Quang Ninh province believes that Article 110 of the current Constitution clearly stipulates that the administrative units of the Socialist Republic of Vietnam include provincial, district, and communal levels, including districts, towns, and townships. Therefore, inheriting this spirit, the revised Article 110 should also clearly stipulate that the government has provincial and communal levels; such a provision will ensure the logic of the draft Resolution currently submitted to the National Assembly.
Regarding the Law on Organization of Local Government (amended) in Clause 7, Article 13 on current decentralization, in the case of giving the Provincial People's Committee the right to adjust regulations related to the issuance of documents to adjust the process and procedures for flexible implementation of the tasks it receives decentralization or the subordinate unit at the commune level receives decentralization; it needs to be clearly regulated to ensure implementation. Regarding the Draft Law on Cadres and Civil Servants (amended), delegates suggested that the Law needs to change the policy of connecting cadres from the commune level to the provincial level, after removing the district level.
Participating in giving comments on the Law on Organization of Local Government (amended), delegate Nguyen Thi Thu Ha, Deputy Head of the Provincial Delegation of National Assembly Deputies, agreed with the provisions in Clause 2 on communes - administrative units in rural areas, wards - administrative units in urban areas and special zones - administrative units in islands. However, islands should be understood as the entire sea and airspace in that area. For example, an archipelago or many islands and also the part adjacent to the coastal area. Therefore, it is necessary to specify more clearly that the special zone - administrative unit in the island area.
As currently in Quang Ninh, with Co To and Van Don, it is not possible to manage only each island but also the surrounding water surface and coastal areas. The delegates also proposed to continue to promote decentralization and delegation between state agencies at the central level and the local level; between provincial and commune-level local authorities; decentralization between the tasks and powers of the People's Committee and the Chairman of the People's Committee, ensuring smooth and effective operations. In addition, the delegates also contributed additional comments on a number of provisions in the draft Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution; the draft Law on Cadres and Civil Servants (amended).
