
Discussion session Group 11 was chaired by comrade Hoang Duy Chinh, member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Bac Kan province, with the participation of delegates from the National Assembly Delegations of Bac Kan, Long An , Son La, and Vinh Long provinces.
At the meeting, delegate Ho Thi Kim Ngan, member of the Provincial Party Committee, Secretary of Cho Moi District Party Committee, made in-depth analysis and specific comments on the provisions in the draft law amending and supplementing a number of articles of the Law on Planning.
Delegates highly appreciated the urgency of developing and promulgating the Law amending and supplementing a number of articles of the Law on Planning to promptly concretize the policies and guidelines of the Party and State on perfecting institutions and resolving issues arising when implementing the organizational arrangement of the political system, especially building a two-level local government model.

However, delegates believe that the scope of amendments should be limited to issues that are truly problematic, urgent and have been carefully reviewed. Specifically, in the context of implementing the current two-level local government organization model (provincial and communal levels), it is necessary to focus on amending regulations directly related to this new organizational model. Expanding the scope of amendments to too many contents, especially when there has not been a full review and thorough assessment of compatibility with specialized laws such as the Land Law, Mineral Law, Geology Law, Electricity Law, Public Investment Law, etc., will easily lead to a lack of feasibility when the law comes into effect.
Regarding the regulations on the planning system, the draft law stipulates: “National planning, regional planning, provincial planning, technical and specialized planning are allowed to be established simultaneously. The planning that is established and assessed first will be decided or approved first; for urban and rural planning, it is implemented according to the provisions of the law on urban and rural planning”.
Delegate Ho Thi Kim Ngan said that the Law on Planning No. 57 has removed urban and rural planning from the national planning system, so it is unnecessary to repeat the above regulation. In addition, according to Article 3 of the Law on Urban and Rural Planning, the “master plan of the urban and rural system” is defined as national sectoral planning, and the preparation, appraisal and approval must be carried out in accordance with the Law on Planning. Thus, there is an overlap and ambiguity between the regulations, which need to be clarified to avoid conflicts in application.
Regarding the principle of “simultaneous” planning, the delegate emphasized that this policy has been decided by the National Assembly in Resolution No. 61/2022 to remove difficulties in implementing the Law on Planning. However, the current draft only stipulates that “simultaneous” planning is allowed without specific instructions on the order, time, and process of planning. This will cause difficulties in the implementation process. Therefore, it is recommended that the Government should specify more clearly in the draft law or assign clear guidance responsibilities.
Regarding the provisions on decentralization of authority, the current draft Law tends to decentralize the authority to approve strategic plans, such as national marine spatial planning and national land use planning from the National Assembly to the Government. According to delegate Ho Thi Kim Ngan, this needs to be carefully considered because these are strategic, comprehensive plans that have a great impact on the country, so they should still be under the decision-making authority of the National Assembly to ensure the role of supervision and long-term development orientation.
The specific, practical and dedicated comments of the delegates will contribute to perfecting the draft law, ensuring feasibility, consistency and suitability with the government model in the coming period./.
