Proposing criminal proceedings against individuals and organizations producing and trading cosmetics with signs of crime

On May 20, the Drug Administration of Vietnam ( Ministry of Health ) sent an official dispatch to the Department of Health of provinces and cities regarding strengthening the management of cosmetic products.

The Ministry of Health recommends that localities continue to step up inspection and examination of the implementation of legal regulations on cosmetics management for cosmetics manufacturing and trading enterprises in the area. At the same time, regularly and proactively coordinate closely with the local Steering Committee 389, the Market Management Department, and relevant functional agencies in the area to strengthen the inspection and examination of cosmetics circulating in the market.

The Ministry of Health recommends that localities and authorities step up inspection of cosmetics trading on social networks.

The Ministry of Health also requested localities to strengthen inspection of cosmetics business activities on e-commerce trading floors and social networking platforms such as TikTok, Zalo, Facebook, YouTube... to promptly detect and handle illegal cosmetics production and trading activities, suspected counterfeit cosmetics, cosmetics in circulation that have not been granted a declaration receipt number, cosmetics of unknown origin; advertising cosmetics with features and uses beyond the inherent features and nature of the product.

In particular, during the inspection process, if any organization or individual is found to be in violation, it must be strictly handled, and all suspected counterfeit cosmetics, cosmetics of unknown origin, cosmetics of poor quality, and unsafe for consumers must be recalled and destroyed. At the same time, the case file must be transferred to the investigation agency for criminal handling according to regulations in cases where there are signs of crime (large value of goods, causing serious consequences, organized violations, recidivism, etc.).

The Ministry of Health also requires that cosmetic production and trading establishments are not allowed to produce or process cosmetics at domestic cosmetic production establishments that have not been granted a certificate of eligibility for cosmetic production; produce formula cosmetics with ingredients in accordance with the declared dossier and in accordance with regulations; are only allowed to put cosmetics into circulation when they have been granted a cosmetic product declaration receipt number by a competent state management agency and must take full responsibility for the safety, quality and effectiveness of the products.
