On September 11th, in Ho Chi Minh City, the Ministry of Planning and Investment organized a workshop to gather opinions from provinces and cities in the Southeast and Mekong Delta regions on the draft Law amending and supplementing a number of articles of the Planning Law, the Investment Law, the Law on Investment under the Public-Private Partnership method, and the Bidding Law.
Regarding the Planning Law, the Ministry of Planning and Investment stated that the amendments aim to improve regulations on the national planning system, revise the content of provincial planning to avoid duplication between provincial planning and urban and rural planning. At the same time, they aim to strengthen decentralization and delegation of authority, and simplify procedures.
Regarding the Investment Law, the Ministry of Planning and Investment also proposed amendments to strengthen the decentralization of investment approval authority to provincial People's Committees, add regulations on the establishment of an Investment Support Fund, amend regulations on the termination of investment projects, and add regulations on special investment procedures for investment projects in certain priority sectors.
Regarding the Law on Investment under the Public-Private Partnership (PPP) method, the Ministry of Planning and Investment stated that in order to remove difficulties and obstacles and further improve the favorable legal framework to attract investment under the PPP (public-private partnership) method, this law amends and supplements several articles.
Specifically, this document proposes expanding and diversifying the scope, forms, and methods of implementing PPP projects, and improving the financial mechanisms for PPP projects.
The Ministry of Planning and Investment proposes simplifying procedures, promoting decentralization of state management for PPP projects, and definitively resolving difficulties and obstacles for transitional BOT and BT projects.
Regarding the Law on Bidding, the Ministry of Planning and Investment also proposed simplified regulations to facilitate saving time and accelerating the progress of project and bidding packages.
Notably, the proposal includes additional bidding packages that can apply the special contractor selection method, while also decentralizing the authority to decide on the application of this method in order to expedite the implementation of projects and bidding packages.
Amend laws to boost economic growth.
According to Deputy Minister of Planning and Investment Nguyen Thi Bich Ngoc, the implementation of policies and laws on planning and investment in practice has revealed many shortcomings, causing obstacles and difficulties.
Therefore, the Ministry of Planning and Investment has reviewed and submitted to the Government a proposal to develop a draft law amending and supplementing several articles of the Planning Law, the Investment Law, the Law on Investment under the Public-Private Partnership method, and the Bidding Law to address obstacles in the implementation process.
This, in turn, helps to remove obstacles and bottlenecks in planning, investment, production, and business activities, thereby promoting economic growth.
