Favorable conditions

Dong Nai province is one of the provinces in the Southeast region that is blessed by nature with quite rich and diverse types of minerals, mainly construction stones, brick and tile clay, construction sand, filling materials, kaolin clay, pozzolan, and slag. Mineral resource exploitation products not only meet the needs of use in the province but also supply to neighboring localities such as Ho Chi Minh City and the Southwest region thanks to the very convenient waterway and road transport system.

Currently, in Dong Nai province, there are 45 mineral mines with valid operating periods, of which the Dong Nai Provincial People's Committee has licensed 41 mines. Of which, the mines exploiting minerals for common construction materials in Dong Nai province have been licensed under the 1996 Mineral Law and the Law amending and supplementing a number of articles of the 2005 Mineral Law, and the 2010 Mineral Law have come into operation.

Dong Nai continues to closely monitor mineral exploitation activities in the province.

Of the total 41 operating mines, the Provincial People's Committee has issued 71 licenses, including initial issuance, re-issuance, adjustment, extension, transfer, and phase 2 licensing.

Pursuant to Decree No. 203/2013/ND-CP dated November 28, 2013, Decree No. 158/2016/ND-CP dated November 29, 2016, Decree No. 67/2019/ND-CP dated July 31, 2019 of the Government, Resolution No. 101/2019/NQ14 of the 14th National Assembly and guidance of the Ministry of Natural Resources and Environment in Document No. 1391/BTNMT-ĐCKS dated March 26, 2021, Dong Nai Provincial People's Committee has issued 40 Decisions approving mineral exploitation rights fees with a total amount of VND 1,825.7 billion, the amount payable from 2014 - 2021 is VND 1,435 billion. Regarding payment of mineral exploitation rights fees in the area, the Department of Natural Resources and Environment requested the People's Committee of Dong Nai province to direct the Provincial Tax Department to review and report specifically to the Provincial People's Committee.

Dong Nai is a province located in the Southern Key Economic Zone, with administrative boundaries adjacent to the provinces and cities of the Southeast. The river boundary between Dong Nai and Lam Dong is 54.5km (Dong Nai and Da Quay rivers); Ho Chi Minh City is 90km (Dong Nai, Nha Be, Dong Tranh, Long Tau rivers); Binh Phuoc province is 43km (Dong Nai river), Binh Duong province is 80km (Dong Nai river, Be river); Binh Thuan province is 70km (La Nga river); Ba Ria - Vung Tau province is 20km (Thi Vai river). However, only the area bordering Lam Dong is licensed to exploit construction sand, including Dong Nai Provincial People's Committee granted 2 licenses, Lam Dong Provincial People's Committee granted 13 licenses.

According to the People's Committee of Dong Nai province, the 2010 Mineral Law and documents guiding the implementation of the Mineral Law stipulate the monitoring of the actual exploited reserves of enterprises, including books, vouchers, purchase and sale invoices, data from raw mineral weighing stations, product weighing stations, results of measuring and drawing maps of the current status of the mine - 2 measurements/year, installing surveillance cameras in storage areas, processing areas, and reporting on the results of mineral activities of enterprises annually. However, for construction sand minerals with reserves replenished annually after the rainy season, the current terrain of the mine is always flooded, so monitoring the actual sand reserves of enterprises is difficult.

Tighten management

In Decision No. 1284/QD-UBND dated May 2, 2019 of the People's Committee of Dong Nai province, the People's Committee of the province established a Steering Committee for inspection, suppression, and protection of forest products and minerals in the province, headed by the Deputy Director - Head of the Provincial Police Investigation Agency. Members of the Steering Committee include leaders of the Departments of Natural Resources and Environment, Agriculture and Rural Development, Transport, the Provincial Military Command and leaders of the People's Committees of districts and cities. Thereby, the combined strength has been mobilized in the fight against and prevention of forest product and mineral exploitation in Dong Nai province.

In addition, the Department of Natural Resources and Environment also advised the Party Committee of Dong Nai Provincial People's Committee to submit to the Standing Committee of Dong Nai Provincial Party Committee to issue Directive No. 13-CT/TU dated September 27, 2021 on continuing to strengthen mineral exploitation and trading in the province. At the same time, the Department of Natural Resources and Environment of Dong Nai continued to advise the Provincial People's Committee to issue Plan No. 15125/KH-UBND dated December 6, 2021 directing departments, branches and localities to implement specific tasks to continue to strengthen the management of mineral exploitation and trading activities in the province.

The leader of Dong Nai Provincial People's Committee said that in order to properly manage sand mining activities on rivers bordering provinces and cities, Dong Nai Provincial People's Committee has agreed with the People's Committees of Binh Duong, Lam Dong, Binh Thuan provinces and Ho Chi Minh City People's Committee to sign Joint Notices on coordination in inspecting and examining sand and gravel mining activities on rivers bordering localities.

Currently, the People's Committees of districts, Long Khanh City and Bien Hoa City have established and completed the Rapid Response Team to receive feedback information and organize inspections and handle illegal mineral exploitation, especially construction sand on rivers in the area; and have set up a hotline, so that when detecting illegal mineral exploitation activities or receiving feedback from people, information on mass media provides information for the Rapid Response Team to handle promptly.

Every year, the People's Committees of districts, Long Khanh City and Bien Hoa City develop plans to patrol, inspect and handle violations of illegal mining activities in the area. Along with that, the inspection of illegal mining activities in the province is a regular task, every 6 months, the Department of Natural Resources and Environment of Dong Nai synthesizes reports from relevant departments, branches and localities to report to the Provincial Party Committee and the People's Committee of Dong Nai Province. Thereby, the Provincial Party Committee and the People's Committee of Dong Nai Province will also have opinions to direct the implementation in the following months.
