Khanh Hoa - Buon Ma Thuot Expressway Project: Many problems in site clearance

Although we are very determined and have completed the work of mobilizing and clearing the land to hand over to the construction unit to implement Component Project 2 of the Khanh Hoa - Buon Ma Thuot Expressway Construction Investment Project Phase 1 (referred to as the Project), due to many reasons, this work in Krong Bong district still has many problems.

Component 2 project through Krong Bong district has a total length of about 16.2 km in Cu Dram commune (5.2 km) and Cu Pui commune (11 km). The area to be handed over to the project is 169.83 ha (Cu Pui commune 120.19 ha, Cu Dram commune 49.64 ha), of which forested land is 75.2 ha, non-forested land subject to encroachment of forestry land is 94.63 ha.

To ensure the progress of project implementation, the Party Committee and the political system of Krong Bong district have resolutely focused on supporting land acquisition and clearance. Accordingly, the district has established a Steering Committee for supporting land acquisition and clearance to build the Khanh Hoa - Buon Ma Thuot expressway and established a Working Group to mobilize land acquisition and clearance for Component 2 of the Khanh Hoa - Buon Ma Thuot expressway project through Krong Bong district. Immediately after its establishment, the working group was divided into 3 groups to coordinate with the Party Committee, government, Fatherland Front and mass organizations of Cu Pui commune and Cu Dram commune to regularly propagate, mobilize and explain so that people clearly understand their rights and benefits when implementing the project's land acquisition and clearance.

Krong Bong district has handed over 169.83 hectares of land area to the investor and construction unit of Component Project 2 of the Khanh Hoa - Buon Ma Thuot Expressway Construction Investment Project Phase 1.

Vice Chairman of the People's Committee of Krong Bong District Nguyen Ngoc Phap said that regarding the land acquisition of the Project, 228 households and 1 organization in the district have received compensation and support money. The People's Committee of the district has directed the relevant agencies and units to urgently hand over the entire 169.83 hectares of land to the investor and the construction unit. However, because the Project investor, Project Management Board 6 ( Ministry of Construction ), has adjusted the design of this project to suit the actual terrain situation, additional land area must be acquired. Therefore, based on the documents provided by the investor, the People's Committee of Krong Bong District has directed the relevant agencies to coordinate in establishing procedures to submit additional adjustments to the planning and land use plan and issue a notice to acquire an area of ​​about 6.34 hectares (the additional acquired area). Currently, the District Land Fund Development Center is coordinating with local authorities, relevant agencies and units to carry out inventory of assets and structures, assets attached to land... in accordance with regulations.

Up to now, Krong Bong district has established and approved 20 compensation, support and site clearance plans (in addition, 3 additional adjustment plans have been issued) for 228 households and 1 organization, with a compensation and support amount of nearly 14.8 billion VND.

Meanwhile, according to the Land Fund Development Center of Krong Bong district, through investigation, survey, measurement, and counting, there are still many households that have not signed the counting records. The reason is that some households do not agree to the additional land acquisition. Moreover, the large additional land acquisition area will greatly impact and affect the economy and income of the family, and some households no longer have land to cultivate. In addition, people had a lot of land acquired, but the support amount of the previous period was too low, so this additional land acquisition did not agree to sign the records; some households were working far away at the time of counting and could not be contacted; they were required to pay the money before signing the records and starting construction...

For example, Mr. Lo A Dung's household (Ea Lueh village, Cu Dram commune), in the previous land acquisition, he agreed to hand over more than 5,719 m2, and in the next additional acquisition, his family is expected to hand over more than 6,865 m2. If this acquisition is made, Mr. Dung's family will have very little land left for production. Moreover, his land is currently growing coffee, which has high economic value but the support level is low, so he does not agree to the inventory.

For unmeasured locations, the extract was extracted from the old cadastral map from many years ago. Due to the lack of measurement and correction, the issued extract was much different from the current status, causing many difficulties in measuring and inventorying assets. Meanwhile, the Provincial People's Committee has not yet made a decision on changing the purpose of forest use to another purpose to implement the project. Therefore, the Center has no basis to take the next steps for the area of ​​1.68 hectares currently managed by Krong Bong Forestry One Member Co., Ltd.

The working group of the People's Committee of Krong Bong district mobilized and explained the site clearance work of the Component Project 2, Phase 1, so that people whose land was recovered would know and agree.

According to Mr. Do Minh Nam, Director of the Land Fund Development Center of Krong Bong district, most of the land area recovered from people is due to encroachment by forestry companies and managed by the People's Committees at the commune level, so it is not subject to compensation according to the provisions of the Land Law 2024; Decree No. 88/2024/ND-CP dated July 15, 2024 of the Government and Decision No. 36/2024/QD-UBND dated October 8, 2024 of the Provincial People's Committee and current regulations. However, the above Decision No. 36/2024/QD-UBND has not yet stipulated other support levels for households using encroachment-origin land within the scope of land recovery for project implementation, so there is no basis for making a compensation and support plan. Instead, it is necessary to prepare documents and procedures to request the Provincial People's Committee to approve a separate support level for the Project, which will take more time and affect the implementation progress.

Therefore, the People's Committee of Krong Bong district has established a working group to continue to direct and support the District Land Fund Development Center to coordinate with investors, Party committees, authorities and organizations of the two communes of Cu Pui and Cu Dram, villages and hamlets with land areas to be recovered to propagate, mobilize, explain and convince about the Party's policies and the State's policies and regimes in the Project's land acquisition work so that people whose land is recovered know and agree. At the same time, direct the District Land Fund Development Center to complete the inventory records, coordinate with the Land Registration Office/Branches of the Land Registration Office to measure and separate plots of land that have been measured together, have incorrect current status... to have a basis for developing compensation, support and resettlement plans, and submit them to competent authorities for appraisal and approval according to regulations.
