Draft Law on Population: Latest amendments to the content of social housing purchase regime

On November 7, at the press conference providing information on the Draft Law on Population and the Law on Disease Prevention organized by the Ministry of Health , responding to some opinions surrounding the issue of regulations on priority beneficiaries of social housing purchase policies in the draft Law on Population, Mr. Le Thanh Dung, Director of the Department of Population (Ministry of Health) said: "In the content of the latest updated draft Law on Population, there is content that men with two children and must have an additional condition that their wives have passed away to be given priority to buy social housing, in order to avoid taking advantage of the policy".

According to Mr. Le Thanh Dung, according to the previous draft, men with two children but whose wives are still alive or divorced are entitled to social housing purchase policies. However, the latest version of the Draft Population Law has amended this provision to only men with two children and whose wives have passed away are entitled to this priority, in order to avoid "legal loopholes" that can be exploited. This is an important adjustment in the group of policies to encourage having two children, aiming to maintain the replacement birth rate.

In the previous draft, there was a provision that women who have given birth to two children or men who have two children but are unmarried or whose wives have died are given priority in buying social housing. This provision has raised public concern about the risk of taking advantage of fake divorces to enjoy the policy, so the drafting committee has revised it, limiting the subjects to men who have two children and whose wives have died. This demonstrates the spirit of practical support for those who raise children alone. The draft law does not change the goal but only makes adjustments to make it clear and suitable for reality. As for buying social housing, it must be in order of priority, the above content is just a condition, and is not too worrying.

“Vietnam is the first country to develop a Population Law, and no other country in the world has this law yet. The Population Law cannot cover all the wishes of more than 100 million people, but it tries to meet the maximum needs of the people. To complete the draft Law, the Drafting Committee is continuing to listen and absorb opinions to make revisions to submit to the National Assembly, hoping to be approved in this session,” Mr. Le Thanh Dung shared.

According to the Department of Population, compared with the Population Ordinance, the draft Law has more specific regulations on policies and measures to improve population quality, communication, advocacy, and education about population.

The Draft Population Law has institutionalized the shift in focus of population policy from family planning to population and development through focusing on standardizing four major policies.

New additional contents compared to the provisions of the Population Ordinance such as: Maintaining the replacement fertility rate, increasing maternity leave, financial support when giving birth, adding priority criteria to buy or rent social housing according to the provisions of the law on housing; minimizing gender imbalance at birth and bringing the gender ratio at birth to a natural balance, prohibiting the selection of fetal gender in any form except for the case of gender determination for the diagnosis and treatment of gender-related genetic diseases; contents adapting to population aging; improving population quality...
