Delegate Chau Quynh Dao - National Assembly Delegation of Kien Giang province stated that normal products and goods may have a certain percentage of defects, but the products of the teaching profession are special, because they are the formation of human personality, requiring perfection in quality and capacity to meet the requirements of the new era. The above requirements are orders from society and the country for teachers, so they are not allowed to create defective products.
From this request, delegate Chau Quynh Giao said that the development of the Law on Teachers is very necessary to create a legal corridor to contribute to improving the effectiveness and efficiency of State management of teachers, creating favorable conditions for building and developing the teaching staff, as well as ensuring a working environment for teachers to feel secure and committed to their work.
Emphasizing the need to promulgate the Law on Teachers, delegate Nguyen Thi Lan Anh (National Assembly delegation of Lao Cai province) cited: The 2013 Constitution of the Socialist Republic of Vietnam defineseducation development as the top national policy to improve people's knowledge, develop human resources, and nurture talents (Article 61). In particular, the decisive factor in the quality of education is the teaching staff.
Regarding legal documents, there are 4 Laws that directly regulate issues related to teachers, including: Law on Education 2019, Law on Higher Education (2012 and amended in 2018), Law on Vocational Education 2014...
However, through review, summary, and comparison with the actual needs of the teaching staff and existing policies and laws on teachers, there are still major shortcomings and limitations that have a fundamental impact on the future of Vietnamese education.
Specifically, the current legal system on teachers is not completely consistent with the nature of the teacher's profession. Up to now, there has not been a complete and clear definition of a teacher. Meanwhile, compared to many other sectors, the educational and training activities of teachers in the education and training sector have specific and distinct characteristics.
At the same time, the majority of delegates agreed with the provisions in the draft Law on Teachers presented at the 8th Session. The provisions in the draft basically meet the requirements for building the current teaching staff, creating a legal corridor contributing to improving the effectiveness and efficiency of State management of teachers;

Commenting on a number of specific issues, the Lao Cai Provincial National Assembly delegation suggested that the Drafting Committee consider and ensure consistency for localities. In reality, localities with budgetary conditions have issued separate policies to support teachers, while localities without budgetary conditions have not issued them.
“This does not ensure unity and is unfair among teachers working in localities” – delegate Nguyen Thi Lan Anh acknowledged and said that the teacher policy needs to prioritize and encourage excellent students to enter the Pedagogy sector; people with seniority such as scientists, professors, and doctors who are teaching and working well at universities and research institutes…
In Clause 2, the draft Law on Teachers stipulates: "Salary and salary policies of teachers in non-public educational institutions must not be less than the salary and salary policies of teachers in public educational institutions with the same training level and same title, unless otherwise agreed."
Delegate Nguyen Thi Lan Anh suggested that the Drafting Committee review to ensure consistency and remove the phrase "unless otherwise agreed", because such a provision would cause misunderstandings and is not consistent with the Labor Code, which stipulates that wages are implemented according to the agreement between the employer and the employee.

Giving opinions on the teacher support policy stipulated in Article 28, delegate Tran Van Tien (National Assembly Delegation of Vinh Phuc province) expressed concern that this policy is only suitable for public educational institutions.
For non-public establishments, are teachers entitled to the policies stipulated in this Article? If not, it will create inequality in society. Therefore, the delegate suggested that the agency drafting the draft Law should conduct research to ensure fairness for teachers in society.
In addition, at point d, clause 1, Article 27 stipulates that teachers who are recruited and have their salaries increased by 1 salary level in the administrative career salary scale system for the first time. However, in Article 18 of the draft Law, it is stipulated that for those who are recruited, have to implement the internship, probationary period or guest lecturer regime, it is not clear how the salary and allowance regime will be implemented.
Therefore, delegate Tran Van Tien suggested that the drafting agency should study and supplement regulations on salary regimes for interns, probationary employees or guest lecturers.
According to delegate Nguyen Thi Lan Anh, it is necessary to create an environment to build and develop a team of teachers in the future; including implementing policies for teachers, ensuring a safe and friendly working environment so that teachers can feel secure and committed to their work and profession. "Based on the above reasons, the promulgation of the Law on Teachers is very necessary" - delegate Nguyen Thi Lan Anh expressed her opinion.
