ANTD.VN - The Ministry of Finance is seeking comments on the draft Government Decree regulating environmental protection fees (EPF) for emissions.
According to the Ministry of Finance, the development of a Decree on environmental protection fees for emissions is necessary to institutionalize the policies of the Party and State, build a synchronous legal system of fees, suitable to the practical situation of environmental protection, and to gradually raise environmental protection awareness of organizations, individuals discharging waste and the whole society.
At the same time, promptly and reasonably mobilize resources from emission dischargers to create resources for environmental protection activities for the air.
Who is subject to environmental protection fees?
According to Article 88 of the Law on Environmental Protection, there are 2 sources of emissions causing air pollution that need to be managed and controlled: dust and gas emissions, including:
Firstly, means of transport, machinery, equipment, and construction works emit dust and exhaust gas.
Second, facilities, production, business and service projects that discharge emissions.
Some opinions propose to regulate environmental protection fees for all types of emissions that pollute the environment and all of the above-mentioned emission sources.
However, the Ministry of Finance believes that the regulation of environmental protection fees for emissions must ensure feasibility in implementation, efficiency and suitability with socio -economic conditions of each period.
For the first emission source, specialized laws do not have regulations to determine: Total discharge volume, content of each pollutant in the emission; responsibility of organizations, individuals discharging emissions and management agencies in investing in equipment and technology to manage this emission source.
Therefore, if there is a fee for this emission source, there is no basis to determine the total volume of emissions and the amount of fee payable.
On the other hand, the regulation of collecting fees for means of transport is not feasible, especially collecting fees for motorbikes, most of which are essential means of transport for low-income people, which will affect people's income.

Therefore, based on the legal regulations on environmental protection for emissions, the current situation of emission management activities, and referring to international experience, the Ministry of Natural Resources and Environment has developed and proposed, and the Ministry of Finance submits to the Government for immediate consideration, the fee payers are facilities that discharge emissions that the environmental protection law stipulates can control emissions.
Accordingly, the subjects subject to environmental protection fees as prescribed in this Decree are dust and industrial emissions discharged into the environment by projects, production, business and service establishments specified in column (2) of Appendix XXIX issued with Decree No. 08/2022/ND-CP and are subject to environmental licenses (emission facilities).
What is the fee?
According to the draft Decree, the fee collection level will include fixed fees and variable fees for environmental pollutants.
Accordingly, a fixed fee of VND3 million/year will be applied to facilities that discharge emissions that are not subject to emission monitoring.
For facilities that discharge emissions and are subject to emission monitoring, in addition to the fixed fees mentioned above, variable fees must also be paid depending on the pollutants.
Specifically as follows: For dust, the total collection is 800 VND/ton; NOx (including NO2 and NO) is 800 VND/ton; SOx is 700 VND/ton; CO is 500 VND/ton.
For facilities discharging emissions with concentrations of environmental pollutants in the emissions 30% lower than the content prescribed in the National Technical Regulation on Industrial Emissions, the fee is 75% of the fee payable according to the calculation formula prescribed in this Decree.
Facilities discharging emissions with concentrations of environmental pollutants in the emissions from 30% to 50% lower than the content specified in the National Technical Regulation on Industrial Emissions, the fee is equal to 50% of the fee payable according to the fee calculation formula in the Decree.
For public utility waste discharge facilities that recycle and treat domestic solid waste, common industrial solid waste, medical waste, and hazardous waste, the fee is 50% of the fee payable according to the calculation formula in the Decree.
