Previously, on the afternoon of November 3, the National Assembly discussed in groups the draft Law on E-commerce. There were 69 comments from National Assembly deputies; the discussion atmosphere was lively, with many comments expressed with enthusiasm, frankness, intelligence, and responsibility.

Delegates agreed on the need to promulgate the Law on E-commerce, of which 28 opinions said that it is necessary to have regulations at the Law level to specifically regulate specific and complex contents and activities; fully institutionalize the Party's policies and guidelines on developing the market of goods and services according to civilized and modern transaction organization methods; in accordance with urgent requirements related to digital commerce, rapid development of commercial transactions in the current electronic environment, especially after the COVID-19 pandemic, creating a synchronous, stable, transparent and solid legal basis for breakthrough development of the digital economy as well as meeting the requirements of state management, protecting the legitimate rights and interests of consumers and businesses in the field of e-commerce.

Some opinions said that the provisions of the Law on E-Commerce are closely related to many other relevant laws; it is recommended to review and compare with the provisions of the Civil Code, the Commercial Law, the Law on Electronic Transactions, the Law on Credit Institutions, the Law on the State Bank, the Law on Data, the Law on Consumer Rights Protection, the Law on Advertising, the Law on Network Information Security, the Law on Commerce, the Law on Personal Data Protection, tax laws, etc. and the draft laws being submitted to the National Assembly for consideration, comments and approval at the 10th Session (draft Law on Cyber ​​Security, draft Law on Digital Transformation, Law on Artificial Intelligence), the draft laws expected to be submitted to the National Assembly according to the 2026 Legislative Program to avoid duplication, overlap, contradiction and ensure consistency and unity in the legal system.

There are also some opinions related to issues such as: livestream sales, the concept of "intermediary e-commerce platform", the concept of "seller", criteria, business conditions and different classifications according to platform types, clarifying the terms "large digital platform" and "electronic documents in commercial transactions"...

At the meeting, each opinion of the delegates was discussed, discussed and clarified by the examining agency and the drafting agency.

Representatives of agencies such as Tax, Customs, State Bank, Science and Technology or Justice all had explanations to clarify issues raised by delegates related to specialized management fields.

Urgently complete the draft law

It is known that during the process of law development, as soon as the draft Law on E-commerce was drafted, the Economic and Financial Committee (the reviewing agency) accompanied and closely coordinated with the Ministry of Industry and Trade (the drafting agency) to promptly handle problems.

Mr. Nguyen Thanh Cong - Member of the Economic and Financial Committee said that after synthesizing the comments, the Committee coordinated with the Ministry of Industry and Trade and relevant ministries and branches to urgently organize a meeting to review the entire draft Law, absorb, revise, supplement and explain to complete.

He added that the review process is still continuing as more opinions are received from industry associations and affected subjects. “ We listen to all channels and stakeholders to ensure that the Law, when issued, truly facilitates all participants, aiming at the goal of serving the development of the country, people and businesses ,” Mr. Nguyen Thanh Cong emphasized.

The Law on E-commerce was submitted by the Government to the National Assembly for consideration and approval of the Law project at the 10th Session of the 15th National Assembly according to the 1-session process. Immediately after the Law on E-commerce is promulgated by the National Assembly, the Government will assign relevant ministries and branches to immediately develop and promulgate sub-law documents to guide the implementation of the Law in a synchronous, feasible and suitable manner in accordance with the domestic and international context, contributing to promoting the effective and sustainable development of e-commerce and digital economy in the spirit of Resolution No. 57 of the Politburo.
